AN ACT in relation to vehicles.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Illinois Vehicle Code is amended by adding
Section 6-108.1 as follows:
(625 ILCS 5/6-108.1 new)
Sec. 6-108.1. Notice to Secretary; denial of license;
persons under 18.
(a) The State's Attorney must notify the Secretary of
the charges pending against any person younger than 18 years
of age who has been charged with a violation of this Code or
the Criminal Code of 1961 arising out of an accident in which
the person was involved as a driver and that caused the death
of or a type A injury to another person. A "type A injury"
includes severely bleeding wounds, distorted extremities, and
injuries that require the injured party to be carried from
the scene. The State's Attorney must notify the Secretary on
a form prescribed by the Secretary.
(b) The Secretary, upon receiving notification from the
State's Attorney, may deny any driver's license to any person
younger than 18 years of age against whom the charges are
pending.
(c) The State's Attorney must notify the Secretary of
the final disposition of the case of any person who has been
denied a driver's license under subsection (b).
(d) The Secretary must adopt rules for implementing this
Section.
Section 99. Effective date. This Act takes effect upon
becoming law.
