AN ACT concerning real property.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Article 5.
Section 5-5. Upon payment of the sum of $1, the Director
of Natural Resources, on behalf of the State of Illinois, is
authorized to convey by quitclaim deed to the Village of
Bartlett all right, title, and interest in and to the
following described real property:
That part of the Southeast Quarter of Section 36,
Township 41 North, Range 8 East of the Third Principal
Meridian, described as follows: commencing at the Southeast
corner of said Southeast Quarter; thence North 00 degrees 28
minutes 15 seconds West, along the East line of said
Southeast Quarter, a distance of 1,069.80 feet for the Point
of Beginning; thence South 00 degrees 28 minutes 15 seconds
East, along said East line, a distance of 933.00 feet; thence
South 88 degrees 37 minutes 14 seconds West, parallel with
the South line of said Southeast Quarter, a distance of
721.09 feet; thence North 00 degrees 28 minutes 15 seconds
West, parallel with the aforesaid East line, a distance of
565.89 feet; thence South 88 degrees 37 minutes 14 seconds
West, parallel with the aforesaid South line, a distance of
537.87 feet, to the Easterly right of way line of State Route
No. 25 (said right of way line being 33.0 feet Easterly of
the centerline); thence Northerly, along said right of way
line, being along a Curve to the Left having a Radius of
375,747.50 feet and a Chord Bearing of North 02 degrees 41
minutes 22 seconds West, an Arc Distance of 367.16 feet, to a
line that is parallel with the aforesaid South line and
passes through the Point of Beginning; thence North 88
degrees 37 minutes 14 seconds East, along said parallel line,
a distance of 1273.17 feet to the Point of Beginning, being
situated in the Village of Bartlett, Kane County, Illinois,
and containing 20.035 acres, more or less.
Section 5-10. The conveyance of real property authorized
by Section 5-5 shall be made subject to (1) existing public
utilities and any and all reservations, easements, covenants,
and restrictions of record and (2) the express condition that
if said real property ceases to be used for public outdoor
recreational purposes, it shall revert to the State of
Illinois without further action on the part of the State.
Section 5-15. The Director of Natural Resources shall
obtain a certified copy of the portions of this Act
containing the title, the enacting clause, the effective
date, the appropriate Sections containing the land
descriptions of property to be transferred, and this Section
within 60 days after this Act's effective date and, upon
receipt of payment required by the appropriate Sections,
shall record the certified document in the Recorder's office
in the county in which the land is located.
Section 5-20. In consideration of the use of the land by
Hardin County for public purposes and without further
compensation, the Board of Trustees of the University of
Illinois is authorized to convey by quitclaim deed to Hardin
County all right, title, and interest in and to the following
described land in Hardin County, Illinois:
Tract 2
Beginning at a point where the East line of the West-half
(W 1/2) of the Southeast Quarter (SE 1/4) of Section
Fourteen (14), Township Twelve (12) South, Range Eight
(8) East of the Third Principal Median intersects the
North right-of-way line of Illinois State Highway No. 146
(being the Southeast corner of a tract of land conveyed
to the University of Illinois by Warranty Deed recorded
January 10, 1917 in Deed Book 12, at pages 505-506),
thence North a distance of Four Hundred Thirty (430) feet
to a point, thence East a distance of Three Hundred
Thirty (330) feet to a point, thence South a distance of
One Hundred Forty Five and Twenty One Hundredths (145.21)
feet to the North right-of-way line of said highway,
thence in a Southwesterly direction along said
right-of-way line Four Hundred Thirty Five and Ninety
Hundredths (435.90) feet to the point of beginning, being
2.18 acres more or less, situated in HARDIN COUNTY,
ILLINOIS.
Section 5-25. The Board of Trustees of the University of
Illinois shall obtain a certified copy of the portions of
this Act containing the title, the enacting clause, the
effective date, the appropriate Sections containing the land
descriptions of property to be transferred, and this Section
within 60 days after this Act's effective date and shall
record the certified document in the Recorder's office in the
county in which the land is located.
Article 7.
Section 7-10. Upon the payment of the sum of $1 to the
State of Illinois, the Secretary of Human Services is
authorized to convey by quitclaim deed to the County of Union
all right, title, and interest in and to the following
described land in Union County, Illinois, the property to be
used for economic development purposes:
A PART OF SECTION 14, TOWNSHIP 12 SOUTH, RANGE 2 WEST OF
THE THIRD PRINCIPAL MERIDIAN, MORE PARTICULARLY DESCRIBED
AS COMMENCEING AT THE SOUTHEAST CORNER THEREOF AND
RUNNING THENCE NORTHERLY ALONG THE EAST LINE THEREOF A

The conveyance of real property authorized by this
Section shall be made subject to the express condition that
if that real property ceases to be used for public purposes,
it shall revert to the State of Illinois without further
action on the part of the State.
Section 7-15. The Secretary of Human Services shall
obtain a certified copy of the portions of this Act
containing the title, the enacting clause, the effective
date, the appropriate Sections containing the land
descriptions of property to be transferred, and this Section
within 60 days after this Act's effective date and, upon
receipt of payment required by the appropriate Sections,
shall record the certified document in the Recorder's office
in the county in which the land is located.
Article 8.
Section 8-5. Upon the approval of the Livingston County
Board and the payment of the sum of $1 to the State of
Illinois, the Director of State Police is authorized to
convey by quitclaim deed to the County of Livingston all
right, title, and interest in and to a parcel of up to 4
acres of the approximately 11 acres on which the Department
of State Police District 6 communications facility is located
in Pontiac, Livingston County, Illinois. The approximately
11 acres, from which the 4-acre parcel shall be conveyed, is
described as follows:
A part of the Northwest Quarter of Section 27, Township
28 North, Range 5 East of the Third Principal Meridian,
Livingston County, Illinois, described as follows:
Commencing at the Northwest corner of said Section 27,
Thence Due South along the west line of said Section 27 a
distance of 1012.38 feet to a point; Thence Due East a
distance of 214.1 feet to the POINT OF BEGINNING, said
point being a concrete post on the easterly right of way
line of County Highway 11; from said POINT OF BEGINNING,
Thence North 25 degrees 41 minutes 50 seconds East along
said easterly right of way line a distance of 306.10 feet
to a concrete corner post; Thence North 55 degrees 50
minutes 45 seconds East along said easterly right of way
line a distance of 91.00 feet to a concrete corner post;

Section 8-10. The conveyance authorized under Section 8-5
is subject to the condition that if the property conveyed
under that Section is ever not used by the County of
Livingston for public purposes, then title to the property
shall revert to the State of Illinois without further action
on the part of the State.
Section 8-15. The Director of State Police shall obtain
a certified copy of the portions of this Act containing the
title, the enacting clause, the effective date, the
appropriate Sections containing the land descriptions of
property to be transferred, and this Section within 60 days
after this Act's effective date and, upon receipt of payment
required by the appropriate Sections, shall record the
certified document in the Recorder's office in the county in
which the land is located.
Article 10.
Section 10-1. Short title. This Article may be cited as
the Ft. Dearborn United States Army Reserve Center
Retrocession Law.
Section 10-5. Authorization to accept retrocession.
(a) Under the provisions of Section 2683 of Title 10 of
the United States Code, the State of Illinois authorizes
acceptance of retrocession by the United States of America of
exclusive legislative jurisdiction, to the extent such
jurisdiction has not previously been retroceded to the State
of Illinois, the United States retaining a federal
proprietary interest only, over lands consisting of the Ft.
Dearborn United States Army Reserve Center, located at O'Hare
International Airport in Chicago, Cook County, Illinois, more
particularly described as follows:
THAT PART OF THE SOUTHEAST 1/4 OF SECTION 32,
TOWNSHIP 41 NORTH, RANGE 12 EAST OF THE THIRD PRINCIPAL

Further, the State of Illinois accepts retrocession of and
authorizes acceptance of retrocession over all those lands
owned by the United States that may subsequently be
identified by the Department of the Army as part of the Ft.
Dearborn United States Army Reserve Center, although not
included within the legal description contained in this
subsection, to the extent exclusive jurisdiction has not
previously been retroceded to the State of Illinois. Any
additional land over which the State accepts retrocession of
jurisdiction shall be identified in a notice filed by the
Governor as provided in subsection (d).
(b) By retaining in the subject lands a federal
proprietary interest only, there exists a right of the United
States to perform the functions delegated to it by the United
States Constitution and directed by statutory enactment of
the United States Congress without interference from any
source. The State of Illinois may not impose its regulatory
power directly upon the United States and may not tax the
land under the federal proprietary interest; however, the
State of Illinois may tax a lessee's interest in the land to
the extent State law permits.
(c) Subject to subsection (b), the State of Illinois
accepts cession of exclusive federal legislative jurisdiction
from the United States, and the State of Illinois retains all
the legislative jurisdiction over the area it would have if a
private individual rather than the United States owned the
land.
(d) The Governor of the State of Illinois is authorized
to accept the retrocession of exclusive legislative
jurisdiction over the subject lands by filing a notice of
acceptance with the Illinois Secretary of State.
(e) Upon transfer by deed of subject lands, or any
portion thereof, by the United States of America, the
proprietary interest retained by the United States shall
expire as to the particular property transferred.
ARTICLE 20.
Section 20-5. Upon the payment of the sum of $50 to the
Department of Natural Resources, the Director of Natural
Resources is authorized to convey by quitclaim deed all
right, title, and interest in and to the following described
real property in Johnson County, Illinois to the Cedar Grove
Church, of the Village of Buncombe, County of Johnson, State
of Illinois:
The South 70.00 feet of the West 50.00 feet of the
Southwest Quarter of the Northeast Quarter of Section 31,
Township 11 South, Range 2 East of the Third Principal
Meridian, Johnson County, Illinois, as said Southwest
Quarter of the Northeast Quarter was surveyed by Edward
J. Reeder, I.P.L.S. No. 2546, during the months of
February through May of 1997.
Section 20-10. The Director of Natural Resources shall
obtain a certified copy of this Act within 60 days after its
effective date and, upon receipt of payment required by this
Act, shall record the certified document in the Recorder's
Office in the county in which the land is located.
ARTICLE 30.
Section 30-2. For and in consideration of the sum of $1,
the Board of Trustees of Southern Illinois University is
authorized to convey, by quitclaim deed executed by the
chairperson and attested by the secretary of the Board of
Trustees of Southern Illinois University, to the Board of
Trustees of Lewis and Clark Community College District No.
536 all rights, title, and interest of the Board of Trustees
of Southern Illinois University in and to the following
described real estate:
Parcel 1:
A parcel of land, known as Lot 8 of the Subdivision
of Block 1, Leclaire, as the same appears in Plat Book 6
Page 19; (Except coal and other minerals underlying, with
right to mine and remove same from thereunder), in
Madison County, Illinois.
Parcel 2:
A tract of land situated in the Southeast Quarter of
Section 11, Township 4 North, Range 8 West of the Third
Principal Meridian, within the corporate limits of the
City of Edwardsville, Madison County, Illinois; being
more particularly Lots 12, 13, 14, 15, 17, 18, 19 and the
Northerly portion of Lot 20 of the Subdivision of Block
1, Leclaire, a Subdivision of said Edwardsville,
Illinois, and of record in Plat Book 6, Page 19 and Lots
9, 10, 11 and 16 of the Revised Plat of Lots 9, 10, 11
and 16 of Block 1, Leclaire, as the same appears in Plat
Book 7, Page 15 and all abutting or contiguous streets
and alleys as vacated by Ordinance Number 628 a copy of
which was recorded March 3, 1948 as Document 114-618, in
Book 1007 Page 388 and Ordinance Number 851 a copy of
which was recorded as Document 124-4123 all being more
fully described as follows:
From a point at the Northeast corner of Lot 1, Block 1,
of the Subdivision of Block 1 Leclaire, a Subdivision of
the City of Edwardsville, Madison County, Illinois, as
the same appears in Plat Book Number 6 Page 19 and which
said point being at the Southwest corner of Brown Street
and Wolf Street, in said Edwardsville, Illinois, measure
200.0 feet South 0 degrees 42 minutes East along the said
West line of Brown Street to a point at the Northeast

of the tract hereinafter described and conveyed; thence

Article 90.
Section 90-50. The Code of Civil Procedure is amended by
changing Section 7-103 as follows:

organized pursuant to the provisions of the Airport
Authorities Act, (i) for the acquisition of 160 acres, or
less, of land or interests therein for the purposes
specified in that Act which may be necessary to extend,

dredging or cleaning the Salt Creek in DuPage County;
(21) by St. Clair County, Illinois, for the
development of a joint use facility at Scott Air Force
Base;
(22) by the Village of Summit, Illinois, to acquire
land for a waste to energy plant;

1990, by the Department of Transportation or by any unit
of local government under the terms of an
intergovernmental cooperation agreement between the
Department of Transportation and the unit of local

1990, by the City of Morris for the development of the
Morris Municipal Airport;
(25) for a period of 1 year after June 19, 1991, by
the Greater Rockford Airport Authority for airport
expansion purposes;
(26) for a period of 24 months after June 30, 1991,
by the City of Aurora for completion of an instrument
landing system and construction of an east-west runway at
the Aurora Municipal Airport;
(27) for the acquisition by the Metropolitan Pier
and Exposition Authority of property described in
subsection (f) of Section 5 of the Metropolitan Pier and
Exposition Authority Act for the purposes of providing
additional grounds, buildings, and facilities related to
the purposes of the Metropolitan Pier and Exposition
Authority;
(28) for a period of 24 months after March 1, 1992,
by the Village of Wheeling and the City of Prospect
Heights, owners of the Palwaukee Municipal Airport, to
allow for the acquisition of right of way to complete the
realignment of Hintz Road and Wolf Road;

date of this amendatory Act of 1992, by the
Bloomington-Normal Airport Authority for airport
expansion purposes;
(30) for a period of 24 months after September 10,
1993, by the Cook County Highway Department and Lake
County Department of Transportation to allow for the
acquisition of necessary right-of-way for construction of
underpasses for Lake-Cook Road at the Chicago
Northwestern Railroad crossing, west of Skokie Boulevard,
and the Chicago, Milwaukee, St. Paul and Pacific Railroad
crossing, west of Waukegan Road;
(31) for a period of one year after December 23,
1993, by the City of Arcola and the City of Tuscola for
the development of the Arcola/Tuscola Water Transmission
Pipeline Project pursuant to the intergovernmental
agreement between the City of Arcola and the City of
Tuscola;
(32) for a period of 24 months from December 23,
1993, by the Village of Bensenville for the acquisition
of property bounded by Illinois Route 83 to the west and
O'Hare International Airport to the east to complete a
flood control project known as the Bensenville Ditch;
(33) for a period of 9 months after November 1,
1993, by the Medical Center Commission for the purpose of
acquiring a site for the Illinois State Police Forensic
Science Laboratory at Chicago, on the block bounded by
Roosevelt Road on the north, Wolcott Street on the east,

by White County for the acquisition of a 3 1/2 mile
section of Bellaire Road, which is described as follows:

Southwest Corner of the Southeast 1/4 of Section 9,

date of this amendatory Act of the 91st General Assembly,
by DuPage Public Safety Communications (DU-COMM), a unit
of intergovernmental cooperation, for the acquisition of
property including land, buildings, towers, fixtures, and
other improvements located at Cloverdale, Illinois and
described as follows:
A tract or parcel of land situated in the Southeast
Quarter (SE 1/4) of Section Twenty-one (21), Township
Forty (40) North, Range Ten (10) East of the Third
Principal Meridian, more particularly described as
follows:
Commencing at the Southwest corner of the
Southeast Quarter (SE 1/4) of said Section
Twenty-one (21), measure North, along the West line
of the Southeast Quarter (SE 1/4) of said Section
Twenty-one (21) 1287.35 feet, then East at right
angles to the said West line of the Southeast
Quarter (SE 1/4) of said Section Twenty-one (21),
292.57 feet to the point of beginning;
Thence East along the last described course
208.71 feet, thence South at right angles to the
last described course 208.71 feet, thence West at
right angles to the last described course 208.71
feet, thence North in a direct line 208.71 feet to
the point of beginning; also
A right of way and easement thirty-three (33) feet
in width for the construction, maintenance, and use of
(a) a roadway suitable for vehicular traffic, and (b)

communication lines as said Company may from time to time
desire, consisting of poles, wires, cables, conduits,
guys, anchors, and other fixtures and appurtenances, the
center line of which right of way and easement is

tract or parcel of land above described, distant
Southerly 16.5 feet from the Northwest corner of
said tract or parcel, thence Westerly at right
angles to the West line of the Southeast Quarter (SE
1/4) of said Section Twenty-one (21), 293 feet more
or less to the public road situated on the West line
of the Southeast Quarter (SE 1/4) of said Section
Twenty-one (21), Township and Range aforesaid;
(95) for a period of 3 years after the effective date of
this amendatory Act of the 91st General Assembly (in the case
of the permanent easements described in items (A) and (C)),
by the City of Crest Hill, for acquisition of the following
easements:
(A) Permanent easement for the purposes of
installation, maintenance, and use of water or sewer, or
both water and sewer, lines in, along, through, and under
the following legally described property:
The East 70 feet of the North half of the North half
of the Southeast Quarter of Section 30, Township 36
North, and in Range 10, East of the Third Principal
Meridian (Except therefrom the North 12 Rods of the East
13 1/2 Rods thereof, and also except the South 99 feet of
the East 440 feet thereof), in Will County, Illinois.
(B) Temporary easement for purposes of initial
construction of the water or sewer, or both water and
sewer, lines in, along, through, and under the permanent
easement described in item (A). The temporary easement
herein shall arise on September 1, 1999 and shall cease
on August 31, 2001 and is legally described as follows:
The East 100 feet of the North half of the North
half of the Southeast Quarter of Section 30, Township 36
North, and in Range 10, East of the Third Principal
Meridian (Except therefrom the North 12 Rods of the East
13 1/2 Rods thereof, and also except the South 99 feet of
the East 440 feet thereof), in Will County, Illinois.
(C) Permanent easement for the purposes of
installation, maintenance, and use of water or sewer, or
both water and sewer, lines in, along, through, and under
the following legally described property:
The East 70 feet of the West 120 feet of the South
half of the Southeast Quarter of Section 30, in township
36 North, and in Range 10 East of the Third Principal
Meridian, in Will County, Illinois, excepting therefrom
the following described tracts:
Exception 1: That part of said South half lying
Southwesterly of the Northeasterly right-of-way line of
the Elgin, Joliet and Eastern Railway Company, in Will
County, Illinois.
Exception 2: The West 200 feet of said South half,
in Will County, Illinois.
Exception 3: That part of the South half of the
Southeast Quarter of Section 30, Township 36 North, and
in Range 10 East of the Third Principal Meridian,
described as follows: Beginning at a point 250 feet East
of the West line of said South half of the Southeast
Quarter and 180.58 feet North of the South line of said
South half of the Southeast Quarter; thence North along a
line 250 feet East of and parallel with the West line of
said Southeast Quarter a distance of 1004.55 feet to a
point; thence Northwesterly along a diagonal line 65.85
feet to its intersection with a line drawn 200 feet East
of and parallel to the West line of said Southeast
Quarter, said point also being 100.75 feet South of the
North line of the South half of said Southeast Quarter,
as measured along said parallel line; thence South along
the last described parallel line a distance of 1045.02
feet to a point 50 feet West of the point of beginning
and 180.58 feet North of the South line of said Southeast
Quarter; thence East 50 feet to the point of beginning,
in Will County, Illinois.
Exception 4: Beginning at the Southeast corner of
the Southeast Quarter of Section 30, Township 36 North,
and in Range 10 East of the Third Principal Meridian,
thence Northerly along the East line of said Section for
a distance of 346.5 feet; thence Westerly along a line
346.5 feet distant from and parallel with the South line
of said Section for a distance of 297 feet; thence
Southerly along a line 297 feet distant from and parallel
with the East line of said Section for a distance of
346.5 feet to a point, said point being on the South line
of said Section; thence Easterly along said South line of
said Section 297 feet to the point of beginning, in Will
County, Illinois.
Exception 5: That part dedicated for highway
purposes in instrument recorded January 28, 1986 as
Document No. R86-03205 described as follows: That part of
the South half of the Southeast Quarter of Section 30,
Township 36 North, and in Range 10 East of the Third
Principal Meridian bounded and described as follows:
Beginning at the point of intersection of the
Northeasterly right-of-way line of the Elgin, Joliet and
Eastern Railway Company with the South line of said
Southeast Quarter, thence on an assumed bearing of North
90.00 degrees 00 minutes 00 seconds East along said South
line a distance of 288.02 feet; thence North 00 degrees
00 minutes 00 seconds East a distance of 33.0 feet;
thence North 86 degrees 25 minutes 22 seconds West a
distance of 352.57 feet to the Northeasterly right-of-way
line of said railway company; thence South 49 degrees 15
minutes 53 seconds East along said Northeasterly
right-of-way line, a distance of 84.28 feet to the point
of beginning, in Will County, Illinois.
Exception 6: The North 850 feet of the East 1025
feet of the South half of the Southeast Quarter of
Section 30, Township 36 North, and in Range 10 East of
the Third Principal Meridian, in Will County, Illinois.
(D) Temporary easement for purposes of initial
construction of the water or sewer, or both water and
sewer, lines in, along, through, and under the permanent
easement described in item (C). The temporary easement
herein shall arise on September 1, 1999 and shall cease

in Cook County, IL;
Property bounded by Bothwell Street, Railroad
right-of-way, Plum Grove Road and Chicago Avenue in the
Village of Palatine;
Lots 1 through 8 in Block K, of the Town of Palatine, a
subdivision of the West 16 2/3 acres of the South 31 acres of
the West 1/2 of the Southwest 1/4 of Section 14 and the
Southeast 24.12 acres of the South 31 acres of the East 1/2
of the Southeast 1/4 of Section 15, Township 42 North, Range
10, East of the Third Principal Meridian, Ante-Fire,

Property bounded by Wood Street, Brockway Street and
Railroad right-of-way in the Village of Palatine;
Lots 45 through 50 and 58 through 64 of Arthur T.

Section 16, Township 42, Range 10 East of the Third Principal
Meridian, in Cook County, IL, recorded on June 16, 1919; and
Property bounded by Railroad right-of-way, Brockway Street

In a proceeding subject to this Section, the plaintiff,
at any time after the complaint has been filed and before
judgment is entered in the proceeding, may file a written
motion requesting that, immediately or at some specified
later date, the plaintiff either be vested with the fee
simple title (or such lesser estate, interest or easement, as
may be required) to the real property, or specified portion
thereof, which is the subject of the proceeding, and be
authorized to take possession of and use such property; or
only be authorized to take possession of and to use such
property, if such possession and use, without the vesting of
title, are sufficient to permit the plaintiff to proceed with
the project until the final ascertainment of compensation;
however, no land or interests therein now or hereafter owned,
leased, controlled or operated and used by, or necessary for
the actual operation of, any common carrier engaged in
interstate commerce, or any other public utility subject to
the jurisdiction of the Illinois Commerce Commission, shall
be taken or appropriated hereunder by the State of Illinois,
the Illinois Toll Highway Authority, the sanitary district,
the St. Louis Metropolitan Area Airport Authority or the
Board of Trustees of the University of Illinois without first
securing the approval of such Commission.
Except as hereinafter stated, the motion for taking shall
state: (1) an accurate description of the property to which
the motion relates and the estate or interest sought to be
acquired therein; (2) the formally adopted schedule or plan
of operation for the execution of the plaintiff's project;
(3) the situation of the property to which the motion
relates, with respect to the schedule or plan; (4) the
necessity for taking such property in the manner requested in
the motion; and (5) if the property (except property
described in Section 3 of the Sports Stadium Act, or property
described as Site B in Section 2 of the Metropolitan Pier and
Exposition Authority Act) to be taken is owned, leased,
controlled or operated and used by, or necessary for the
actual operation of, any interstate common carrier or other
public utility subject to the jurisdiction of the Illinois
Commerce Commission, a statement to the effect that the
approval of such proposed taking has been secured from such
Commission, and attaching to such motion a certified copy of
the order of such Commission granting such approval. If the
schedule or plan of operation is not set forth fully in the
motion, a copy of such schedule or plan shall be attached to
the motion.

Article 99.
Section 99-5. Effective date. This Act takes effect
