AN ACT to amend the Mental Health and Developmental
Disabilities Code by adding Section 2-110.5.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Mental Health and Developmental
Disabilities Code is amended by adding Section 2-110.5 as
follows:
(405 ILCS 5/2-110.5 new)
Sec. 2-110.5. Electro-convulsive therapy for minors. If
a recipient is a minor, that recipient's parent or guardian
is authorized, only with the approval of the court under the
procedures set out in Section 2-107.1, to provide consent for
participation of the minor in electro-convulsive therapy if
the parent or guardian deems it to be in the best interest of
the minor. In addition to the requirements in Section
2-107.1, prior to the court entering an order approving
treatment by electro-convulsive therapy, 2 licensed
psychiatrists, one of which may be the minor's treating
psychiatrist, who have examined the patient must concur in
the determination that the minor should participate in
treatment by electro-convulsive therapy.
Section 99. Effective date. This Act takes effect upon
becoming law.
