AN ACT concerning property.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 4. The Director of Natural Resources, on behalf
of the State of Illinois, is authorized to convey and quit
claim to the Hamilton County Water District, its successors
and assigns, for and in consideration of $10 paid to the
Department of Natural Resources, a non-exclusive,
unobstructed, perpetual public utility easement for the
purpose of erecting, constructing, installing, and laying,
and thereafter using, operating, inspecting, repairing,
maintaining, replacing, and removing, an underground water
pipeline and miscellaneous appurtenances on, over, under, and
across the following described real property, together with
the right of ingress and egress over the adjacent lands of
the State of Illinois, its successors and assigns, for the
purpose of this easement, subject to such conditions as may
be determined by the Department, to wit:
A strip of land 20 feet in width centered on the
water pipeline installed or to be installed on and across
the Easterly part of the Southeast Quarter of the
Northeast Quarter and the Southerly part of the Southwest
Quarter of the Southwest Quarter in Section 27, Township
4 South, Range 5 East of the Third Principal Meridian,
and on and across the Westerly part of the West Half of
the Southwest Quarter of Section 20, Township 3 South,
Range 5 East of the Third Principal Meridian, all in
Hamilton County, Illinois.
The Director of Natural Resources shall obtain a certified
copy of the portions of this Act containing the title, the
enacting clause, the effective date, and this Section within
60 days after the effective date of this Act and, upon
receipt of payment required by this Section, shall record the
certified copy in the Recorder's Office in Hamilton County.
Section 170. Upon the payment of the sum of $252,000.00
to the State of Illinois, the easement for highway purposes
acquired by the People of the State of Illinois is released
over and through the following described land in DuPage
County, Illinois:
Parcel No. 1WY514A:
Those parts of Lots 91 and 92 and that part of the
vacated alley lying North and adjoining said lots in
Taylor and Powers Garden Acres, being a subdivision in
the North Half of Section 34, Township 39 North, Range 9
East of the Third Principal Meridian, according to the
plat thereof recorded September 19, 1929, as Document No.
286552, in DuPage County, Illinois, described as follows:
Beginning at the Northeast corner of said Lot 91; thence
northerly, 3.048 meters [10.00 feet] on an assumed
bearing of North 0 degrees 30 minutes 54 seconds East
along the northerly extension of the East line of said
Lot 91 to the North line of the South Half of said alley
vacated by Document No. 730256; thence North 89 degrees
31 minutes 41 seconds West, 45.016 meters [147.69 feet]
along said North line to a line that is 30.480 meters
[100.00 feet] East of, as measured perpendicular, and
parallel with the center line of Illinois Route 59 as
established by Document No. 321382; thence South 11
degrees 09 minutes 32 seconds West, 47.396 meters [155.50
feet] along said parallel line to a line that is 12.192
meters [40.00 feet] North of, as measured perpendicular
to, and parallel with the South line of said Lots 91 and
92; thence South 89 degrees 28 minutes 10 seconds East,
53.770 meters [176.41 feet] along said parallel line to
the East line of said Lot 91; thence North 0 degrees 30
minutes 54 seconds East, 43.580 meters [142.98 feet]
along said East line to the Point of Beginning.
Said parcel contains 0.2303 hectare [0.569 acre], more or
less.
Reserving unto the State existing access control from the
tract described above:

Parcel No. 1WY514B:
Lot 39 EXCEPT the Northerly 12.192 meters [40.00 feet],
measured perpendicular to the southerly right-of-way line
of Illinois Route 56; ALSO EXCEPT the easterly 7.620
meters [25.00 feet], measured perpendicular to the
westerly right-of-way line of Illinois Route 59, in
Robert Bartlett's Green Acres, being a subdivision in the
East Half of Section 33 and in the West Half of Section
34, Township 39 North, Range 9 East of the Third
Principal Meridian, according to the plat thereof
recorded October 20, 1943, as Document No. 454884, in
DuPage County, Illinois.
Said parcel contains 0.7673 hectare [1.896 acres], more
or less.
It is understood and agreed that there is no existing
right of access, nor will access be permitted in the
future by the State of Illinois, Department of
Transportation, from or over the premises above described
to and from FA Route 131 (IL 56), previously declared a
freeway, nor will the Department of Transportation permit
access to FAP Route 338 (IL 59), except at the south 50
feet of the easterly line of parcel 1WY514B, subject to
the Department of Transportation's "Policy on Permits for
Access Driveways to State Highways."
Section 175. Upon the payment of the sum of $10,000 to
the State of Illinois, the rights or easements of access,
crossing, light, air, and view from, to, and over the
following described line and FA Route 12 are restored subject
to permit requirements of the State of Illinois, Department
of Transportation:
Parcel No. 800XA75:
Direct access to FA Route 12 (marked U.S. Route 40) shall
be restored to 79.04 feet of a tract of land abutting the
southerly right of way line of said highway from the
Northwest Corner of the existing easterly right of way
line of SA Route 1 (marked Troy-Lebanon Road) and said
southerly right of way line of FA Route 12 at Station
245+68, a distance of 75.00 feet right of the centerline
of said FA Route 12 easterly along said southerly right
of way line 200.00 feet to the Point of Beginning at
Station 247+49.68 easterly 79.04 feet to Station
248+28.72 in the Southeast Quarter of Section 9, Township
3 North, Range 7 West of the Third Principal Meridian,
Madison County, Illinois.
Stipulations on the above described Access Rights that a
25 ft. entrance that has right-in and right-out only
access to and from the property to FA Route 12 (marked
U.S. Route 40).
Section 900. The Secretary of Transportation shall
obtain a certified copy of the portions of this Act
containing the title, the enacting clause, the effective
date, the appropriate Section or Sections containing the land
descriptions of property to be transferred or otherwise
affected, and this Section within 60 days after its effective
date and, upon receipt of payment required by the Section or
Sections, if any payment is required, shall record the
certified document in the Recorder's Office in the county in
which the land is located.
Section 905. Upon the payment of the sum of $20,750 to
the Quincy Veterans Home Fund, the Director of the Department
of Veterans' Affairs is authorized to convey to Refreshment
Services, Inc., an Illinois corporation organized under the
laws of Delaware and registered to do business in Illinois,
by quit claim deed the following described real property:
A part of E. A. Dudley's Addition to the City of Quincy,
a subdivision of a part of the Southeast quarter of Section
26 in Township 1 South of the Base Line and in Range 9 West
of the Fourth Principal Meridian, in the City of Quincy,
Adams County, Illinois, being more particularly and described
as follows:
Commencing at the northeast corner of Block 36 of said E.
A. Dudley's Addition, said point being a point on the west
line of North 12th Street a record distance of 33 feet west
and 429 feet north of the southeast corner of said Section
26, thence westerly along the north line of said Block 36 a
distance of 16 feet to the Point of Beginning, thence from
said Point of Beginning continuing westerly along the north
line of said Block 36 a distance of 450.75 feet to the
northwest corner of said Block 36, thence southerly along the
west line of said Block 36 a distance of 216.00 feet to the
northeast corner of property conveyed to the City of Quincy
as recorded in Book 463 of Deeds at Page 705 and 706 in the
Office of the Adams County Recorder of Deed, thence westerly
along the north line of said City of Quincy property a
distance of 310.00 feet, thence northerly parallel with the
west line of said Block 36 a distance of 342.00 feet, thence
easterly parallel with the north line of said Block 36 a
distance of 655.15 feet to a point on a line which deflects
northwesterly from the west line of said North 12th Street at
an angle of 45 degrees, thence southerly parallel with the
west line of said North 12th Street a distance of 20 feet to
the Point of Beginning, containing 3.61 acres, more or less.
The Director of the Department of Veterans' Affairs shall
obtain a certified copy of the portions of this Act
containing the title, the enacting clause, the effective
date, and this Section within 60 days after its effective
date and, upon receipt of the payment required by this
Section, shall record the certified document in the
Recorder's Office in Adams County.
Section 999. Effective date. This Act takes effect upon
becoming law.
