AN ACT in relation to certain land.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. Upon the payment of the sum of $5,625.00 to
the State of Illinois, the easement for highway purposes
acquired by the People of the State of Illinois is released
over and through the following described land in Peoria
County, Illinois:
Parcel No. 403D10V
Lot 118, except the Easterly 5 feet of said lot, in the
Highlands Subdivision, an addition to the Village of
Peoria Heights, being in the Northwest quarter of Section
27, Township 9 North, Range 8 East of the Fourth
Principal Meridian, Peoria County, Illinois, containing
3,750 square feet, more or less, or 0.086 acre more or
less.
It is understood and agreed that there is no existing
right of access nor will access be permitted in the future by
the State of Illinois, Department of Transportation, from or
over the premises above described to and from FA Route 49 (US
150), previously declared a freeway, nor will access from or
to the parcel be permitted from the adjacent Vincent Avenue
nor the adjacent alley.
Section 10. Upon the payment of the sum of $200.00 to the
State of Illinois, the easement for highway purposes acquired
by the People of the State of Illinois is released over and
through the following described land in Peoria County,
Illinois:

A tract of land in part of the Southeast Quarter of
Section Twenty (20) being in Township Seven (7) North,
Range Seven (7) East of the Fourth Principal Meridian,
being more particularly described as follows: Commencing
at the Southwest corner of the Southeast Quarter of said
Section 20; thence South 88 Degrees 33 Minutes 48 Seconds
East, along the South line of the Southeast Quarter of
said Section 20, 285.05 feet to the Point of Beginning of
the tract to be described: From the Point of Beginning,
thence North 76 Degrees 03 Minutes 42 Seconds East, 76.05
feet; thence South 03 Degrees 50 Minutes 19 Seconds East,
20.25 feet to a point on the South line of the Southeast
Quarter of said Section 20; thence North 88 Degrees 33
Minutes 48 Seconds West along the South line of the
Southeast Quarter of said Section 20, 75.19 feet to the
Point of Beginning, continuing 758 square feet (0.017
acre) more or less.
It is understood and agreed that there is no existing
right of access nor will access be permitted in the future by

Section 15. Upon the payment of the sum of $2,600.00 to
the State of Illinois, the Secretary of the Department of
Transportation is authorized to convey by quitclaim deed all
right, title, and interest in and to the following described
land in Macoupin County, Illinois to Fae McWard:

North, Range 8 West, of the Third Principal Meridian,
Macoupin County, Illinois, described as follows:
Commencing at a stone at the South Quarter corner of said
Section 20 thence North 89 degrees 48 minutes 45 seconds
West along the South line of said Section 20, a distance
of 167.91 feet to the Point of Beginning, being the
southeasterly corner of the Hettick Rest Area. From said
Point of Beginning continue North 89 degrees 48 minutes
45 seconds West along said South line 254.75 feet to a
point 40.00 feet left of the centerline of F.A. Route 608
(IL 111); thence North 34 degrees 39 minutes 58 seconds
East along a line 40.00 feet left of and parallel to the

Commencing at a stone at the South Quarter corner of said
Section 20 thence North 89 degrees 48 minutes 45 seconds
West along the South line of said Section 20, 46.60 feet
to the point of beginning. From said Point of Beginning
continue North 89 degrees 48 minutes 45 seconds West
along said South line 121.31 feet; thence North 34
degrees 39 minutes 58 seconds East along the easterly
line of the Hettick Rest Area known as 1966-6RA, 536.00
feet to the northeasterly corner of said rest area;
thence North 55 degrees 20 minutes 02 seconds West along

access, crossing, light, air and view to and from the

restored subject to permit requirements of the State of

The release of access rights for freeway mentioned herein
extends along the centerline of IL Route 111 from the
south line of Section 20, to a point 1,007.68 feet (1,011
feet original deed) northeasterly of the south line of
Section 20 in Township 11 North, Range 8 West, of the
Third Principal Meridian.
The above description refers to a part of S.B.I. Route
111, Section 1966-6, Parcel 1, Tract B recorded in Book 623
Page 508 in Macoupin County, Illinois.
Section 20. Upon the payment of the sum of $214.00 to
the State of Illinois, the easement for highway purposes
acquired by the People of the State of Illinois is released

northeasterly right of way line of a strip of land 100
feet in width, formerly the Missouri Pacific Railroad,
with the southwesterly line of Lot 6 in U.S. Survey 430,
Claim 339; thence South 38 degrees 20 minutes 10 seconds
East along said northeasterly right of way line of said
railroad, 93.85 feet to the Point of Beginning. From said

authorized to convey by quitclaim deed to the City of Mattoon
all right, title, and interest in and to the following
described land in Coles County, Illinois:

containing the title, the enacting clause, the effective

affected, and this Section within 60 days after its effective
date and, upon receipt of payment required by the Section or
Sections, if any payment is required, shall record the
certified document in the Recorder's Office in the county in
which the land is located.
Section 910. Upon payment to the Department of Natural
Resources of the sum equal to appraised fair market value,
the Director of the Department, on behalf of the State of
Illinois, is authorized to execute and deliver to Allan
Docksteiner and Betty Docksteiner, husband and wife, their
heirs, successors and assigns, a quitclaim deed to the

exchanged are equal in area and are of marginal but

Resources shall obtain an opinion of title from the Illinois
Attorney General certifying that the State of Illinois will
receive merchantable title to the real property referred to

to execute and deliver to Norfolk Southern Corporation, its
successors and assigns, for and in consideration of $1.00

All that part, if any, of the abandoned Chicago &
Northwestern Railway Company right-of-way that adjoins
the above described Parcels 3C and 3A-1, in which the
State of Illinois has any right, title or interest.
Section 980. The conveyance of real property authorized
by Section 975 shall be made subject to: (1) existing
public utilities, existing public roads, and any and all
reservations, easements, covenants, and restrictions of
record; and (2) the express condition that if the real
property ceases to be used for public purposes it shall
revert to the State of Illinois, Department of Natural
Resources.
Section 985. The Director of the Department of Natural
Resources, on behalf of the State of Illinois, is authorized
to execute and deliver to the United States of America, its
successors and assigns, in consideration of the purposes of
and pursuant to that mitigation agreement made and entered
into by and between the Consolidated Coal Company, a
Delaware corporation, the State of Illinois by and through
the Department of Natural Resources, and the United States
of America by and through the United States Army Corps of
Engineers, dated January 9, 1996, a quitclaim deed to the
following described real property:
The SURFACE ONLY of 10 acres off the North side of the
Northwest Quarter of the Northwest Quarter of Section 26;
ALSO,
The SURFACE ONLY of the South 16 acres of the Southwest
Quarter of the Southwest Quarter except 4 acres in the
Northeast corner thereof described as beginning at a
point 7 rods North of the Southeast corner of said
tract, running North 25 rods, thence West 25 3/5 rods,
thence South 25 rods, thence East 25 3/5 rods to the
place of beginning, in Section 23;
All in Township 4 South, Range 2 East of the 3rd
Principal Meridian, Jefferson County, Illinois.
Section 990. The conveyance of real property authorized
by Section 985 shall be made subject to any and all
easements, reservations, covenants, and restrictions of
record.
Section 995. The Director of the Department of Natural
Resources, on behalf of the State of Illinois, is authorized
to exchange certain real property in Monroe County,
Illinois, referred to in this Section as Parcel 1, for
certain real property in Monroe County, Illinois of equal
value, referred to in this Section as Parcel 2, the Parcels
being described as follows:
PARCEL 1
All that part of the following described tract lying
southerly of the southerly line of the Missouri Pacific
Railroad, to wit: Tax Lot 1 of Survey 289, Claim 1313,
EXCEPT a 10 foot roadway from Bluff to the railroad
tract; Tax Lot 1 of Survey 290, Claim 1304; Tax Lot 1 of
Survey 291, Claim 951; Tax Lot 1 of Survey 292, Claim
202; Lot 6, also known as Tax Lot 2 of Survey 293, Claim
1306, being all in Township 4 South, Range 10 West of
the Third Principal Meridian, EXCEPTING that part
conveyed to the St. Louis Valley Railway, a corporation,
for right-of-way by deed dated July 5, 1901, and
recorded in Book 36 at page 75, in the Recorder's Office
of Monroe County, Illinois, and ALSO EXCEPTING that part
conveyed to Missouri Pacific Railroad Company, a
corporation, by deed dated March 6, 1975, and recorded
April 8, 1975, as Instrument 100532 in Deed Record 117
at page 546, in the Recorder's Office of Monroe County,
Illinois; containing 20 acres, more or less, all situated
in the County of Monroe and the State of Illinois.
PARCEL 2
Thirty-eight (38) acres, more or less, lying southerly of
the southerly line of the Missouri Pacific Railroad,
being a part of that tract of land conveyed to Eugene B.
Stadter and Richard H. Stadter, by that Warranty Deed
recorded April 3, 1984 in Deed Record 143 at page 208,
in the Recorder's Office of Monroe County, Illinois, a
more detailed description to be prepared from an
accurate survey to be made by an Illinois Professional
Land Surveyor, the cost of such survey to be paid by the
Department of Natural Resources.
Section 1000. The transaction described in Section 995
will be to the mutual advantage of both parties; each party
shall be responsible for any and all title costs associated
with their respective properties.
Section 1005. The Director of the Department of Natural
Resources shall obtain an opinion of title from the Illinois
Attorney General certifying that the State of Illinois will
receive merchantable title to the real property referred to
in Section 995 as Parcel 2.
Section 1010. On behalf of the State of Illinois, the
Director of the Department of Natural Resources is authorized
to execute and deliver its interest in the real property,
described as follows, to the Town of Naples, its successors
and assigns, for and in consideration of $1 paid to the
Department; such interest consisting of a public recreational
easement for the purpose of launching and landing boats into
the Illinois River:
Part of the Southwest Quarter of fractional Section 12,
Township 15 North, Range 13 West of the 3rd P.M., Scott
County, Illinois, more particularly described as follows:
Beginning at a point approximately 1540 feet South of the
North line of above described fractional Section 12; said
point being the North line of Shelly Street in the
Village of Naples, at its intersection with the West toe
of slope of the Mauvaisterre Drainage and Levee District
levee; thence in a Northeasterly direction parallel to
the levee 140 feet; thence Westerly 240 feet, more or
less, to the East shore line of the Illinois River;
thence in a Southwesterly direction along the low water
line of the East shore of the Illinois River 630 feet
more or less; thence Easterly 240 feet, more or less, to
the West toe of slope of the above described levee;
thence Northeasterly along the toe of the levee 490 feet,
more or less, to the place of beginning, containing 4.3
acres, more or less.
Section 1015. The Director of Natural Resources shall
obtain a certified copy of the portions of this Act
containing the title, enacting clause, the effective date,
the appropriate Section or Sections containing the land
descriptions of property to be transferred or otherwise
affected, and this Section within 60 days after its
effective date and, upon receipt of payment required by the
Section or Sections, if any payment is required, shall
record the certified document in the Recorder's Office in
the county in which the land is located.
Section 9999. Effective date. This Act takes effect upon
becoming law.
