    AN ACT in relation to certain land.

    Be it enacted by the People of  the  State  of  Illinois,
represented in the General Assembly:

    Section  5.   Upon the payment of the sum of $5,625.00 to
the State of Illinois,  the  easement  for  highway  purposes
acquired  by  the People of the State of Illinois is released
over and through  the  following  described  land  in  Peoria
County, Illinois:
Parcel No. 403D10V
    Lot  118,  except the Easterly 5 feet of said lot, in the
    Highlands Subdivision, an  addition  to  the  Village  of
    Peoria Heights, being in the Northwest quarter of Section
    27,  Township  9  North,  Range  8  East  of  the  Fourth
    Principal  Meridian,  Peoria County, Illinois, containing
    3,750 square feet, more or less, or 0.086  acre  more  or
    less.
    It  is  understood  and  agreed that there is no existing
right of access nor will access be permitted in the future by
the State of Illinois, Department of Transportation, from  or
over the premises above described to and from FA Route 49 (US
150),  previously declared a freeway, nor will access from or
to the parcel be permitted from the adjacent  Vincent  Avenue
nor the adjacent alley.

    Section 10. Upon the payment of the sum of $200.00 to the
State of Illinois, the easement for highway purposes acquired
by  the  People of the State of Illinois is released over and
through  the  following  described  land  in  Peoria  County,
Illinois:
Parcel No. 409504V
    A tract of land in  part  of  the  Southeast  Quarter  of
    Section  Twenty  (20)  being in Township Seven (7) North,
    Range Seven (7) East of the  Fourth  Principal  Meridian,
    being  more particularly described as follows: Commencing
    at the Southwest corner of the Southeast Quarter of  said
    Section 20; thence South 88 Degrees 33 Minutes 48 Seconds
    East,  along  the  South line of the Southeast Quarter of
    said Section 20, 285.05 feet to the Point of Beginning of
    the tract to be described: From the Point  of  Beginning,
    thence North 76 Degrees 03 Minutes 42 Seconds East, 76.05
    feet; thence South 03 Degrees 50 Minutes 19 Seconds East,
    20.25  feet to a point on the South line of the Southeast
    Quarter of said Section 20; thence North  88  Degrees  33
    Minutes  48  Seconds  West  along  the  South line of the
    Southeast Quarter of said Section 20, 75.19 feet  to  the
    Point  of  Beginning,  continuing  758 square feet (0.017
    acre) more or less.
    It is understood and agreed that  there  is  no  existing
right of access nor will access be permitted in the future by
the  State of Illinois, Department of Transportation, from or
over the premises above described to and from FA  Route  317,
(US 24), previously declared a freeway at this location.

    Section  15.  Upon the payment of the sum of $2,600.00 to
the State of Illinois, the Secretary  of  the  Department  of
Transportation  is authorized to convey by quitclaim deed all
right, title, and interest in and to the following  described
land in Macoupin County, Illinois to Fae McWard:
Parcel No. 6160X02
    A  part  of  the  South  Half  of Section 20, Township 11
    North, Range 8 West, of  the  Third  Principal  Meridian,
    Macoupin   County,   Illinois,   described   as  follows:
    Commencing at a stone at the South Quarter corner of said
    Section 20 thence North 89 degrees 48 minutes 45  seconds
    West  along the South line of said Section 20, a distance
    of 167.91 feet to  the  Point  of  Beginning,  being  the
    southeasterly corner of the Hettick Rest Area.  From said
    Point  of  Beginning continue North 89 degrees 48 minutes
    45 seconds West along said South line 254.75  feet  to  a
    point 40.00 feet left of the centerline of F.A. Route 608
    (IL  111);  thence North 34 degrees 39 minutes 58 seconds
    East along a line 40.00 feet left of and parallel to  the
    centerline  of  F.A.  Route  608  (IL 111) 1,494.33 feet;
    thence South 85 degrees 11 minutes 41 seconds East  19.60
    feet  to  the existing easterly right of way line of F.A.
    608 (IL 111); thence  South  34  degrees  39  minutes  58
    seconds  West  along  the  existing easterly right of way
    line 823.88 feet to the northwesterly corner of said rest
    area; thence South 55 degrees 20 minutes 02 seconds  East
    along the northerly line of said rest area 193.00 feet to
    the northeasterly corner of the Hettick Rest Area: thence

    easterly line of the Hettick Rest Area 536.00 feet to the
    Point of Beginning.  Said  tract  contains  3.251  acres,
    more  or  less.  The  above  description refers to S.B.I.
    Route 111, Section 1966-6RA, Parcel 1, Tract  A  recorded
    in book 629, page 204 in Macoupin County, Illinois.
    And  further; upon the payment of the sum in this Section
to the State of Illinois, the scenic easement acquired by the
People of the State of Illinois is released over and  through
the following described land in Macoupin County, Illinois:
Parcel 6160X01
    A  part  of  the  South  Half  of Section 20, Township 11
    North, Range 8 West, of  the  Third  Principal  Meridian,
    Macoupin   County,   Illinois,   described   as  follows:
    Commencing at a stone at the South Quarter corner of said
    Section 20 thence North 89 degrees 48 minutes 45  seconds
    West  along the South line of said Section 20, 46.60 feet
    to the point of beginning.  From said Point of  Beginning
    continue  North  89  degrees  48  minutes 45 seconds West
    along said  South  line  121.31  feet;  thence  North  34
    degrees  39  minutes  58  seconds East along the easterly
    line of the Hettick Rest Area known as  1966-6RA,  536.00
    feet  to  the  northeasterly  corner  of  said rest area;
    thence North 55 degrees 20 minutes 02 seconds West  along
    the  northerly  line  of  said rest area 193.00 feet to a
    point on the easterly right of way line of F.A. Route 608
    (IL 111), said  point  being  57  feet  left  of  Station
    586+37.94;  thence North 34 degrees 39 minutes 58 seconds
    East along said right of way  line  300.00  feet  to  the
    northerly  line  of  the scenic easement; thence South 55
    degrees 20 minutes 02 seconds East along  said  northerly
    line  293.00  feet  to  the  northeasterly corner of said
    scenic easement; thence South 34 degrees  39  minutes  58

    The  above  description  refers to F.A. Route 93, Section
1967-15SE Parcel 1, Tract B recorded in Book 653 page 409  in
Macoupin County, Illinois.
    And  further;  in  consideration  of  the  payment of the
amount set forth in this Section, the rights or easements  of
access,  crossing,  light,  air  and  view  to  and  from the
following described land  and  FA  Route  608  (IL  111)  are
restored  subject  to  permit  requirements  of  the State of
Illinois, Department of Transportation:

    A part of the South  half  of  Section  20,  Township  11
    North,  Range  8  West,  of the Third Principal Meridian,
    Macoupin County, Illinois, described as follows:
    The release of access rights for freeway mentioned herein
    extends along the centerline of IL  Route  111  from  the
    south line of Section 20, to a point 1,007.68 feet (1,011
    feet  original  deed)  northeasterly of the south line of
    Section 20 in Township 11 North, Range  8  West,  of  the
    Third Principal Meridian.
    The  above  description  refers to a part of S.B.I. Route
111, Section 1966-6, Parcel 1, Tract B recorded in  Book  623
Page 508 in Macoupin County, Illinois.

    Section  20.   Upon  the payment of the sum of $214.00 to
the State of Illinois,  the  easement  for  highway  purposes
acquired  by  the People of the State of Illinois is released
over and through the following described  land  in  Whiteside
County, Illinois:
Parcel 2DWH021:
    A  parcel of land in the Northeast Quarter of Section 18,
    Township 22 North, Range 7 East of the  Fourth  Principal
    Meridian,   Whiteside   County,  Illinois,  described  as
    follows:
    Commencing at the Northeast Corner of  said  Section  18;
    thence  Westerly  on  the  North Line of said Section 18,
    said line having a bearing of South 89 degrees 32 minutes
    26 seconds West, a distance of 333.93 feet to  the  Point
    of Beginning of the hereinafter described parcel of land;
    thence  Southeasterly on a line having a bearing of South
    23 degrees 48 minutes 37  seconds  East,  a  distance  of
    104.27 feet to a point in the Southerly Right-of-Way Line
    of  a  public  highway  designated  Illinois Route 88 (FA
    Route  646);  thence  Northwesterly  on  said   Southerly
    Right-of-Way  Line,  a distance of 243.54 feet on a curve
    concave to the South, having a radius of 485.07  feet,  a

    of Beginning of the hereinafter described parcel of land;

    Section 25.  Upon the payment of the sum of $5,350.00  to
the  State  of  Illinois,  the  easement for highway purposes
acquired by the People of the State of Illinois  is  released
over  and  through  the following described land in St. Clair
County, Illinois:
Parcel No. 800XA29:
    A part of Lot 1 of U.S. Survey 430, Claim 339, Township 1
    North, Range 10 West of the Third Principal Meridian, St.
    Clair County, Illinois, more  particularly  described  as
    follows:
    Commencing  at an iron pin set at the intersection of the
    northeasterly right of way line of a strip  of  land  100
    feet  in  width,  formerly the Missouri Pacific Railroad,
    with the southwesterly line of Lot 6 in U.S. Survey  430,
    Claim  339; thence South 38 degrees 20 minutes 10 seconds
    East along said northeasterly right of way line  of  said
    railroad, 93.85 feet to the Point of Beginning. From said
    Point of Beginning; thence South 70 degrees 31 minutes 51
    seconds  East  along a line 50.00 feet south of, measured
    at right angles to, the southwesterly line of said Lot 6,
    a distance of 172.06 feet; thence  South  59  degrees  33
    minutes 15 seconds East, 256.05 feet to the west right of
    way  line  of  FAI  Route 255; thence South 29 degrees 41

Parcel 800XA29 herein described contains 1.067  acre  (46,473
    sq. ft.).
    Basis  of bearings South 29 degrees 41 minutes 09 seconds
    West along  the  centerline  of  FAI  Route  255  between
    Station 478+00 and Station 484+00.
    It  is  understood  and  agreed that there is no existing
right of access nor will access be permitted in the future by
the State of Illinois, Department of Transportation, from  or
over  the premises above described to and from FAI Route 255,
previously declared a freeway.

    Section 30.  Upon the payment of the sum of $2,625.00  to
the  State  of  Illinois,  the Secretary of the Department of
Transportation is authorized to convey by quitclaim deed  all
right,  title, and interest in and to the following described
land in Madison County, Illinois, to  Little Flock  Primitive
Church.
Parcel No. 800XA36:
    A  part of the Southeast Quarter of the Southeast Quarter
    of Section 32, Township 5 North,  Range  8  West  of  the
    Third  Principal Meridian, Madison County, Illinois, more
    particularly described as follows:

    Commencing at a stone at the Southeast Corner of  Section
    32,  Township  5  North,    Range  8  West  of  the Third
    Principal Meridian; thence North 00 degrees 17 minutes 34
    seconds East along the east line of said  Section  32,  a

Parcel  800XA36, Tract A, herein described contains 5,625 sq.
    ft. (0.129 acre).
    Tract B:
    Commencing at a stone at the Southeast Corner of  Section
    32, Township 5 North, Range 8 West of the Third Principal
    Meridian;  thence  along  said  east  line of Section 32,
    North 00 degrees 17 minutes 34 seconds East, 340.68  feet
    to  the  Point  of  Beginning; thence North 76 degrees 06
    minutes 16 seconds West, 262.16 feet along a line 10 feet
    from and parallel with the existing  northerly  right  of
    way  line  of  SBI  Route  159  (Old Illinois Route 143);
    thence North 13 degrees 19 minutes 00 seconds East, 10.00
    feet; thence South 76 degrees 06 minutes 16 seconds  East
    along  said  existing  northerly right of way line of SBI

Parcel  800XA36, Tract B, herein described contains 2,610 sq.
    ft. (0.060 acre).
Parcel 800XA36, Tract A and B, herein  described  contains  a
    total of 8,235 sq. ft. (0.189 acre).
    Bearing on centerline of FA Route 50 (Illinois Route 143)
    between  Station  25+72.11 and Station 30+29.70, North 86
    degrees 38 minutes 53 seconds  East  was  derived    from
    Centerline  Survey  Map  for  FA  Route  50 (filed in the
    Madison County  Recorder's Office in Plat Book 8 at  Page
    49), Section 125-1.
    It  is  understood  and  agreed that there is no existing
right of access  nor will access be permitted in  the  future
by  the State of Illinois, Department of Transportation, from
or over the premises above described to and from FA Route  50
(IL 143) previously declared a freeway.

    Section  35.   In  consideration  of an intergovernmental
agreement between the Illinois Department  of  Transportation
and  the City of Mattoon signed and executed on June 22, 1995
the Secretary of the Department of Transportation  is  hereby
authorized to convey by quitclaim deed to the City of Mattoon
all  right,  title,  and  interest  in  and  to the following
described land in Coles County, Illinois:
Parcel No.5X00517 (1):
    Part  of  the  Northeast  Quarter  (NE  1/4)  of  Section
    Seventeen (17), Township Twelve (12) North,  Range  Eight
    (8)  East  of the Third Principal Meridian, lying between
    the south right-of-way line of the C.C.C. and  St.  Louis
    Railway   Company  right-of-way  and  the  centerline  of
    Illinois State Highway Federal Aid Route 17 (now known as
    IL. Route 16) more particularly described as follows:
    Commencing   at   a   concrete   monument   marking   the
    intersection of the south right-of-way line of the former
    C.C.C.  and  St.  Louis  Railway  Company  (now  City  of
    Mattoon) with the east line of the west 375.0 feet of the
    Northeast Quarter (NE 1/4)  of  Section  Seventeen  (17),
    Township  Twelve  (12) North, Range Eight (8) East of the
    Third Principal Meridian; thence Azimuth 179  degrees  51

    Quarter of the Northeast Quarter and running thence North

    Section  900.   The  Secretary  of  Transportation  shall
obtain   a  certified  copy  of  the  portions  of  this  Act
containing the title,  the  enacting  clause,  the  effective
date, the appropriate Section or Sections containing the land
descriptions  of  property  to  be  transferred  or otherwise
affected, and this Section within 60 days after its effective
date and, upon receipt of payment required by the Section  or
Sections,  if  any  payment  is  required,  shall  record the
certified document in the Recorder's Office in the county  in
which the land is located.

    Section  910.  Upon  payment to the Department of Natural
Resources of the sum equal to appraised  fair  market  value,
the  Director  of  the  Department, on behalf of the State of
Illinois, is authorized  to  execute  and  deliver  to  Allan
Docksteiner  and  Betty  Docksteiner, husband and wife, their
heirs, successors  and  assigns,  a  quitclaim  deed  to  the
following described real property, provided that the grantees
pay the appraisal, land survey, title and closing cost:
         A  part  of  the  Northeast Quarter of the Southwest
    Quarter of Section 29, Township 9 South, Range 6 East  of
    the  Third  Principal  Meridian, Saline County, Illinois,
    described as follows: Beginning at  the  intersection  of
    the  Easterly  right-of-way  line of Liberty Road and the
    Northwesterly right-of-way line of the abandoned Southern
    Railway Company Railroad, formerly known  as  the  C.C.C.
    and  St.  Louis  Railroad;  thence  from  said  Point  of
    Beginning,  Northeasterly  on  said Railroad right-of-way
    line, a distance  of  351  feet,  more  or  less;  thence
    Southeasterly  on  a  line  at  right  angles to the last
    described course, a distance of 35 feet,  more  or  less;
    thence   Southwesterly   on  a  line  parallel  with  the
    aforesaid Railroad right-of-way line, to its intersection

    Section 915.  The appraised fair market value of the real
property described in Section 910 shall be determined  by  an
independent  fee  appraiser,  whose appraisal report shall be
subject to review and  certification  by  the  Department  of
Natural  Resources.   The  legal  description  of  such  real
property  shall  be  subject  to  review  and approval by the
Department of Natural Resources.

    Section 920.  The conveyance of real property  authorized
by  Section  910  shall  be  made  subject to existing public
utilities,  existing  public   roads,   and   any   and   all
reservations,   easements,  covenants,  and  restrictions  of
record.

    Section 925.  The Director of the Department  of  Natural
Resources,  on behalf of the State of Illinois, is authorized
to  execute and deliver to the County of DuPage, an  Illinois
unit  of  local government, for and in consideration of $1.00
paid to the  Department, a quitclaim deed  to  the  following
described real  property:
    That  part  of Section 6, Township 40 North, Range 9 East
    of  the Third Principal Meridian, described  as  follows:
    commencing  at  the  intersection  of  the  centerline of
    Stearns  Road as dedicated by  Document  424794  and  the
    East  line  of  lands conveyed by Document R73-9999, said
    East line  also    being  the  West  line  of  Linneman's
    Assessment  Plat  as    recorded  by Document R92-032281;

    said East line a distance of  40.07  feet  to  the  North
    right-of-way  line  of Stearns Road as  dedicated for the

    Section  930.  The conveyance of real property authorized
by  Section 925 shall  be  made  subject  to:   (1)  existing
public    utilities  and any and all reservations, easements,
covenants, and  restrictions of record;  and (2) the  express
condition  that  if   the real property ceases to be used for
public purposes it shall  revert to the  State  of  Illinois,
Department of Natural Resources.

    Section  935.   The Director of the Department of Natural
Resources, on behalf of the State of Illinois, is  authorized
to    execute  and  deliver  to  the Oregon Park District, an
Illinois unit  of local government, for and in  consideration
of  $1.00  paid  to    the  Department  and of the conditions
hereinafter mentioned, a  quitclaim  deed  to  the  following
described real property:
    A tract of land described and bounded as follows: Part of
    the  Northwest  Fractional  Quarter of Section three (3),
    Township twenty-three (23) North, Range ten (10) East  of
    the   Fourth Principal Meridian, bounded and described as
    follows:  Commencing at the  Northeast  Corner  of  Block
    thirty-five  (35)    in  the  Town  (now City) of Oregon,
    Illinois, and running   thence  Southeasterly  along  the
    Easterly  line  of  Lots  twelve  (12) and eleven (11) in
    said Block thirty-five (35) to the  Northeast  corner  of
    Lot  ten  (10)  in  said  Block thirty-five  (35); thence
    South along the East line of Block thirty-five  (35)  and

    Section 940. The conveyance of real  property  authorized
by  Section 935 shall be made subject to: (1) existing public
roads      and  utilities;  (2)  any  and  all  reservations,
easements,  covenants, and restrictions of record, including,
but not limited  to, all stipulations set forth in that  deed
from  Commonwealth   Edison Company to the State of Illinois,
dated February 23, 1956  and recorded in Book 237 at page  93
of  the records of Ogle  County, Illinois; (3) an easement to
be reserved for the benefit  of the State  of  Illinois,  its
successors  and  assigns, of the  right of ingress and egress
over and across the real property for  the express purpose of
carrying  out  any  and  all  obligations    stated  in   the
aforementioned  deed  dated  February  23, 1956; and  (4) the
express condition that if the  real  property  ceases  to  be
used  for  public  purposes  it  shall revert to the State of
Illinois, Department of Natural Resources.

    Section 945.  The Director of the Department  of  Natural
Resources,  on behalf of the State of Illinois, is authorized
to  execute and  deliver  to  the  City  of  Murphysboro,  an
Illinois    municipal  corporation, of the County of Jackson,
State of  Illinois, for and in consideration of $1.00 paid to
the  Department, a quitclaim deed to the following  described
real  property:
    The John A. Logan Monument and all appurtenances thereto,
    and  any and all rights that the State of Illinois has in
    or  appertaining  to  such  monument  and  appurtenances,
    together    with  the  land  upon which such monument and
    appurtenances are  located, and including  any  adjoining
    land appertaining to  said monument and appurtenances, if
    any,  all  in  the  City of  Murphysboro, Jackson County,
    Illinois.

    Section 950.  The Director of the Department  of  Natural
Resources,  on behalf of the State of Illinois, is authorized
to    exchange  certain  real  property  in  Jackson  County,
Illinois,  hereinafter referred to as Parcel 2 and Parcel  3,
for  certain    real  property  in  Jackson County, Illinois,
hereinafter referred  to  as  Parcel  1,  the  Parcels  being
described as follows:
    PARCEL 1
    A  part of the Southwest Quarter of the Southeast Quarter
    of  Section 2, Township 8 South,  Range  4  West  of  the
    Third  Principal Meridian, Jackson County, Illinois, more
    particularly  described  as  follows:  Commencing  at the
    Southeast  corner  of  the  Southwest  Quarter   of   the
    Southeast    Quarter  of  said Section 2; thence Westerly
    along the South  line of the  Southwest  Quarter  of  the
    Southeast  Quarter  of    said  Section  2, a distance of

    Section 955.  The lands described in Section  950  to  be
exchanged   are  equal  in  area  and  are  of  marginal  but
equivalent value. The  exchange of  lands   will  be  to  the
mutual  advantage  of  both  parties on the basis of utility;
each party shall be responsible  for any and all title  costs
associated with their respective  properties.

    Section  960.   The Director of the Department of Natural
Resources shall obtain an opinion of title from the  Illinois
Attorney  General  certifying that the State of Illinois will
receive merchantable title to the real property  referred  to
in  Section 950 as Parcel 1.

    Section  965.   The Director of the Department of Natural
Resources, on behalf of the State of Illinois, is  authorized
to   execute and deliver to Norfolk Southern Corporation, its
successors and assigns, for and  in  consideration  of  $1.00
paid  to  the  Department, a non-exclusive grant of permanent
easement,  for  the    purpose   of   operating,   repairing,
maintaining,  removing,  and    replacing  the existing radio
transmitter/receiver, radio  tower,    access  road,  utility
services,  and  all  necessary  appurtenances,  on, over, and
across the following described real property:
    All that part of the following described tract which lies
    southerly of the centerline of  Tunnel  Hill  Road  (also
    known    as  State Aid Route 2&4) and northerly of a line
    drawn perpendicular  to  the  centerline  of  the  former
    right-of-way  of    the  Southern  Railway  Company, said
    perpendicular line being  located 250 feet  southerly  of
    the centerline of said road as  measured on and along the
    centerline  of said former railway,  said part containing
    1.20 acres, more or less, to wit: All  that part  of  the
    Northeast  Quarter  of  the Southeast Quarter  of Section
    35,  Township  11  South,  Range  3  East  of  the  Third
    Principal Meridian, owned by the State  of  Illinois  and
    under   the control and jurisdiction of the Department of
    Natural  Resources (formerly known as the  Department  of
    Conservation),  being  all  that  part  of  said  Quarter
    Quarter  Section   falling within the former right-of-way
    of the Southern  Railway Company,  all  situated  in  the

    Section  970. The grant of easement authorized by Section
965 shall be made subject to:  (1) existing public utilities,
existing public roads, and any and all easements,  covenants,
and  restrictions  of  record;  (2)  the  condition  that the
easement rights  thereby granted shall not  be  exercised  in
any  manner  that  interferes  with,  obstructs,  damages, or
endangers the  facilities  of    the  Department  of  Natural
Resources;  and (3) the condition that  the grant of easement
shall terminate upon cessation of  use  or    abandonment  of
facilities  by  Norfolk Southern Corporation, its  successors
and assigns, for a continuous period exceeding 24  months.

    Section 975.  The Director of the Department  of  Natural
Resources,  on behalf of the State of Illinois, is authorized
to  execute and deliver to the City of Monmouth, an  Illinois
municipal  corporation,  of  the  County  of Warren, State of
Illinois, for and in  consideration  of  $1.00  paid  to  the
Department,  a quitclaim deed to the following described real
property:
    Parcel 2AV
    A part of the East  Half  of  the  Northwest  Quarter  of
    Section    31,  Township  11  North,  Range 2 West of the
    Fourth Principal  Meridian, Warren County, Illinois, more
    particularly  described as follows:
    Beginning at the point of intersection of the  West  line
    of    the  said  East  Half  of  the Northwest Quarter of
    Section 31  and the northwesterly railroad trackage right
    of way line of  the  Burlington  Northern,  Incorporated;
    thence  northerly   1557.03 feet, more or less, along the
    said West line of the  East Half of the Northwest Quarter
    of Section 31; thence   easterly  744.83  feet,  more  or
    less,  to  a point on the  existing westerly right of way
    line of Federal Aid Route 9,  said point being 160.0 feet

    All that  part,  if  any,  of  the  abandoned  Chicago  &
    Northwestern  Railway  Company  right-of-way that adjoins
    the  above described Parcels 3C and 3A-1,  in  which  the
    State of  Illinois has any right, title or interest.

    Section  980.  The conveyance of real property authorized
by  Section 975 shall  be  made  subject  to:   (1)  existing
public    utilities,  existing  public roads, and any and all
reservations,   easements,  covenants,  and  restrictions  of
record;   and  (2)  the    express condition that if the real
property ceases to be used for    public  purposes  it  shall
revert  to  the  State  of  Illinois,   Department of Natural
Resources.

    Section 985.  The Director of the Department  of  Natural
Resources,  on behalf of the State of Illinois, is authorized
to  execute and deliver to the United States of America,  its
successors  and  assigns, in consideration of the purposes of
and  pursuant to that mitigation agreement made  and  entered
into  by    and  between  the  Consolidated  Coal  Company, a
Delaware  corporation, the State of Illinois by  and  through
the  Department   of Natural Resources, and the United States
of America by and  through the United States  Army  Corps  of
Engineers,  dated  January   9, 1996, a quitclaim deed to the
following described real  property:
    The SURFACE ONLY of 10 acres off the North  side  of  the
    Northwest Quarter of the Northwest Quarter of Section 26;
    ALSO,
    The  SURFACE  ONLY of the South 16 acres of the Southwest
    Quarter of the Southwest Quarter except 4  acres  in  the
    Northeast  corner  thereof  described  as  beginning at a
    point 7  rods North  of  the  Southeast  corner  of  said
    tract,  running   North 25 rods, thence West 25 3/5 rods,
    thence South 25  rods, thence East 25  3/5  rods  to  the
    place of beginning, in  Section 23;
    All  in  Township  4  South,  Range  2  East  of  the 3rd
    Principal  Meridian, Jefferson County, Illinois.

    Section 990. The conveyance of real  property  authorized
by    Section  985  shall  be  made  subject  to  any and all
easements,   reservations,  covenants,  and  restrictions  of
record.
    Section  995.   The Director of the Department of Natural
Resources, on behalf of the State of Illinois, is  authorized
to     exchange  certain  real  property  in  Monroe  County,
Illinois,  referred to in  this  Section  as  Parcel  1,  for
certain  real    property in Monroe County, Illinois of equal
value, referred to  in this Section as Parcel 2, the  Parcels
being described as  follows:
    PARCEL 1
    All  that  part  of  the  following described tract lying
    southerly of the southerly line of the  Missouri  Pacific
    Railroad,  to  wit:  Tax Lot 1 of Survey 289, Claim 1313,
    EXCEPT a 10 foot  roadway  from  Bluff  to  the  railroad
    tract;  Tax Lot 1 of Survey 290, Claim 1304; Tax Lot 1 of
    Survey    291,  Claim 951; Tax Lot 1 of Survey 292, Claim
    202; Lot 6,  also known as Tax Lot 2 of Survey 293, Claim
    1306, being all  in Township 4 South, Range  10  West  of
    the  Third  Principal    Meridian,  EXCEPTING  that  part
    conveyed to the St. Louis  Valley Railway, a corporation,
    for  right-of-way  by  deed    dated  July  5,  1901, and
    recorded in Book 36 at page 75, in  the Recorder's Office
    of Monroe County, Illinois, and ALSO  EXCEPTING that part
    conveyed  to  Missouri  Pacific  Railroad    Company,   a
    corporation,  by  deed dated March 6, 1975, and  recorded
    April 8, 1975, as Instrument 100532 in Deed Record    117
    at  page  546, in the Recorder's Office of Monroe County,
    Illinois; containing 20 acres, more or less, all situated
    in  the County of Monroe and the State of Illinois.
    PARCEL 2
    Thirty-eight (38) acres, more or less, lying southerly of
    the southerly line  of  the  Missouri  Pacific  Railroad,
    being a  part of that tract of land conveyed to Eugene B.
    Stadter  and    Richard H. Stadter, by that Warranty Deed
    recorded April 3,  1984 in Deed Record 143 at  page  208,
    in  the  Recorder's  Office of Monroe County, Illinois, a
    more  detailed    description  to  be  prepared  from  an
    accurate survey to be  made by an  Illinois  Professional
    Land Surveyor, the cost of  such survey to be paid by the
    Department of Natural  Resources.

    Section  1000.   The transaction described in Section 995
will be to the mutual advantage of both parties;  each  party
shall  be responsible for  any and all title costs associated
with their respective  properties.

    Section 1005.  The Director of the Department of  Natural
Resources  shall obtain an opinion of title from the Illinois
Attorney General certifying that the State of  Illinois  will
receive  merchantable  title to the real property referred to
in  Section 995 as Parcel 2.

    Section 1010.  On behalf of the State  of  Illinois,  the
Director of the Department of Natural Resources is authorized
to  execute  and  deliver  its interest in the real property,
described as follows, to the Town of Naples,  its  successors
and  assigns,  for  and  in  consideration  of $1 paid to the
Department; such interest consisting of a public recreational
easement for the purpose of launching and landing boats  into
the Illinois River:
    Part  of  the Southwest Quarter of fractional Section 12,
    Township 15 North, Range 13 West of the 3rd  P.M.,  Scott
    County, Illinois, more particularly described as follows:
    Beginning at a point approximately 1540 feet South of the
    North line of above described fractional Section 12; said
    point  being  the  North  line  of  Shelly  Street in the
    Village of Naples, at its intersection with the West  toe
    of  slope of the Mauvaisterre Drainage and Levee District
    levee; thence in a Northeasterly  direction  parallel  to
    the  levee  140  feet;  thence Westerly 240 feet, more or
    less, to the East  shore  line  of  the  Illinois  River;
    thence  in  a Southwesterly direction along the low water
    line of the East shore of the  Illinois  River  630  feet
    more  or less; thence Easterly 240 feet, more or less, to
    the West toe of  slope  of  the  above  described  levee;
    thence Northeasterly along the toe of the levee 490 feet,
    more  or  less, to the place of beginning, containing 4.3
    acres, more or less.

    Section 1015. The Director  of  Natural  Resources  shall
obtain    a  certified  copy  of  the  portions  of  this Act
containing the  title, enacting clause, the  effective  date,
the  appropriate    Section  or  Sections containing the land
descriptions of property   to  be  transferred  or  otherwise
affected,  and  this  Section  within    60  days  after  its
effective  date and, upon receipt of payment  required by the
Section or Sections, if  any  payment  is  required,    shall
record  the  certified  document  in the Recorder's Office in
the county in which the land is located.

    Section 9999. Effective date. This Act takes effect  upon
becoming law.
