    AN ACT concerning safety.
 
    Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
 
    Section 5. The Environmental Protection Act is amended by
adding Sections 22.38a and 22.54b as follows:
 
    (415 ILCS 5/22.38a new)
    Sec. 22.38a. Limitation on fees assessed by local
government on facilities accepting exclusively general
construction and demolition debris. Except in counties with a
population in excess of 1,500,000 residents, a facility
regulated under Section 22.38 of this Act shall not be subject
to annual fees assessed by a unit of local government and that
are directly related to the facility's recycling activities in
excess of $2,000. A home rule unit may not regulate these fees
in a manner that is inconsistent with this Section. This
Section is a limitation under subsection (i) of Section 6 of
Article VII of the Illinois Constitution on the concurrent
exercise by home rule units of powers and functions exercised
by the State.
 
    (415 ILCS 5/22.54b new)
    Sec. 22.54b. Limitation on fees assessed by local
government on facilities that have received a beneficial use
determination. Except in counties with a population in excess
of 1,500,000 residents, a facility that has received a
beneficial use determination from the Agency under Section
22.54 of this Act shall not be subject to annual fees assessed
by a unit of local government and that are directly related to
the facility's recycling activities in excess of $1,500. A home
rule unit may not regulate these fees in a manner that is
inconsistent with this Section. This Section is a limitation
under subsection (i) of Section 6 of Article VII of the
Illinois Constitution on the concurrent exercise by home rule
units of powers and functions exercised by the State.
 
    Section 99. Effective date. This Act takes effect upon
becoming law.
