AN ACT concerning public employee benefits.
|
Be it enacted by the People of the State of Illinois,
|
represented in the General Assembly:
|
Section 5. The Illinois Pension Code is amended by changing |
Section 3-108.3 as follows:
|
(40 ILCS 5/3-108.3)
|
Sec. 3-108.3. Beneficiary. "Beneficiary": A person |
receiving benefits from
a pension fund, including, but not |
limited to, retired pensioners, disabled
pensioners, their |
surviving spouses, minor children, disabled children, and
|
dependent parents. If a special needs trust as described in |
Section 1396p(d)(4) of Title 42 of the United States Code, as |
amended from time to time, has been established for a disabled |
adult child, then the special needs trust may stand in lieu of |
the disabled adult child as a beneficiary for the purposes of |
this Article.

Section 99. Effective date. This Act takes effect upon |
becoming law.
