    AN ACT concerning education.
 
    Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
 
    Section 1. Short title. This Act may be cited as the Higher
Education Fair Admissions Act.
 
    Section 5. Definitions. In this Act:
    "Institution of higher education" or "institution" means
the University of Illinois; Southern Illinois University;
Chicago State University; Eastern Illinois University;
Governors State University; Illinois State University;
Northeastern Illinois University; Northern Illinois
University; Western Illinois University; the public community
colleges of the State; and any other public universities,
colleges, and community colleges now or hereafter established
or authorized by the General Assembly.
    "Standardized test score" means the composite score or any
subscores on the ACT or SAT college admissions test or any
other standardized college admissions test.
 
    Section 10. Test-optional admission policy.
    (a) Each institution of higher education shall adopt a
test-optional policy as part of its undergraduate admissions
process. Under this policy, an institution may not require
applicants who are residents of the State of Illinois to
submit standardized test scores to the institution as a part
of the admissions process, and the submission of standardized
test scores to the institution shall be at the option of the
applicant.
    (b) Subject to subsection (a), nothing in this Act shall
be construed to limit the admissions requirements, standards,
or policies of an institution of higher education.
 
    Section 90. Rules. The Board of Higher Education may adopt
any rules necessary to implement this Act.
 
    Section 99. Effective date. This Act takes effect January
1, 2022.
