Short description: 
CRIM PRO-PROSECUTOR MISCONDUCT                                             

Synopsis of Bill as introduced:
        Amends the Code of Criminal Procedure of  1963  and  the  Unified      
   Code  of  Corrections.   Provides  that  the  court  may  resentence a      
   defendant  in  a  capital  case  on  the  grounds  of  a  prosecutor's      
   misconduct  during  sentencing  if  the  misconduct  is   sufficiently      
   material  to  affect the reliability of the sentence imposed. Provides      
   for sanctions against a defendant's counsel who makes  such  a  motion      
   for resentencing other than in good faith.  Effective immediately.
