CIV PRO-CLASS AUTHORIZATION                                                

Synopsis of Bill as introduced:
        Amends the Code of Civil Procedure. Provides that an attorney may      
   not claim to represent or sue in behalf of any person as a member of a      
   class unless the attorney first provides to  the  court  the  person's      
   written authorization to be so represented. Sets forth contents of the      
   written  authorization. Provides that an attorney seeking to represent      
   a class may not solicit potential members of the class, but  that  the      
   court  may  direct  the  attorney  to  provide  and  pay for notice to      
   potential class members. Provides that no settlement of an action  and      
   no decision or judgment of a court in an action binds a person who has      
   not  affirmatively  consented to joining the action as a member of the      
   class. Provides for penalties. Provides that, if there is  a  conflict      
   with  any  other  law of this State, the new provisions shall control.      
   Provides that the new provisions apply to all civil actions  filed  on      
   or  after  the  effective  date  of  the  new  provisions.   Effective      
   immediately.
