Short description:
CRIM PRO-BAIL DEPOSIT

Synopsis of Bill as introduced:
Amends the Code of Criminal Procedure of 1963. Provides that when
the conditions of the bail bond have been performed and the accused
has been discharged from all obligations, the court shall order the
return of 80% (rather than 90%) of the bail amount and shall retain
20% (rather than 10%) of the amount deposited as bail bond costs.
Provides that the court shall not order bail bond deposited by or on
behalf of a defendant in one case to be used to satisfy the financial
obligations of that same defendant in a different case until the bail
bond is first used to satisfy any unpaid child support obligations.
FISCAL NOTE (Office of Illinois Courts)
HB 5714 would substantially increase the amount of money
retained for bond cost, which would increase revenues for
county government. The fiscal impact of HB 5714 will vary
          by county.
JUDICIAL NOTE (Office of Illinois Courts)
HB 5714 would neither increase nor decrease the number of
          judges needed in the State.
