Short description: 
ELECTROLOGY PRACTICE ACT                                                   

Synopsis of Bill as introduced:
        Creates the Electrology Practice  Act.   Contains  only  a  short      
   title provision.                                                            
        HOUSE AMENDMENT NO. 1.                                                 
          Adds reference to:                                                   
          5 ILCS 80/4.23 new                                                   
        Deletes  everything  after  the  enacting  clause.   Creates  the      
   Electrologist Licensing Act to  provide  for  the  regulation  of  the      
   practice   of   electrology.    Provides  for  administration  by  the      
   Department  of  Professional  Regulation.  Creates  the  Electrologist      
   Licensing  Board.   Provides  for  licensing   and   disciplining   of      
   electrologists.   Deposits   all  fees  and  fines  into  the  General      
   Professions Dedicated Fund.   Provides civil  and  criminal  penalties      
   for  violations.  Preempts home rule. Amends the Regulatory Sunset Act      
   to repeal the new Act on January 1, 2013. Effective immediately.            
        HOUSE AMENDMENT NO. 2.                                                 
          Deletes reference to:                                                
          5 ILCS 80/4.23 new                                                   
          Adds reference to:                                                   
          5 ILCS 80/4.24                                                       
        Provides that the licensure requirement for electrologists begins      
   on January 1, 2004 (rather than January 1,  2003).  Adds  a  provision      
   concerning  the  scope  of  practice  of an electrologist. Changes the      
   repeal date of the new Act to January 1, 2014.  Effective  January  1,      
   2003.                                                                       
        HOUSE AMENDMENT NO. 3.                                                 
        Deletes everything after the enacting clause  with  the  bill  as      
   amended  by  House Amendments Nos. 1 and 2 with the following changes:      
   (i) provides that nothing in the Act shall be construed  to  authorize      
   an  electrologist to use surgery or to prevent a person functioning as      
   an assistant to a person licensed to  practice  medicine  in  all  its      
   branches  from providing electrology services, (ii) removes provisions      
   concerning the Electrologist Licensing Board, (iii)  in  the  list  of      
   qualifications   for  licensure,  makes  changes  in  the  educational      
   requirements   in   electrology,   and   (iv)   removes   professional      
   incompetence from the provisions concerning grounds for discipline.         
        SENATE AMENDMENT NO. 1.                                                
          Adds reference to:

          225 ILCS 65/15-45                                                    
          225 ILCS 80/16                  from Ch. 111, par. 3916              
          225 ILCS 100/14                 from Ch. 111, par. 4814              
        Provides that the continuing education requirement may be  waived      
   in  part or in whole for such good cause as may be determined by rule.      
   Replaces the fee provisions of the new Act. Provides that  gross            
   negligence  in  the  practice  of electrology is a ground                   
   for discipline under the Act. Provides that the Department  may             
   compel  a  person  licensed  under  the  Act  or  who  has applied for      
   licensure or certification pursuant to the Act to submit to  a  mental      
   or  physical  examination,  or  both.  Makes changes in the provisions      
   concerning notice and hearing. Provides a civil penalty for unlicensed      
   practice. Makes other changes.  Amends the  Medical  Practice  Act  of      
   1987,  the  Nursing  and  Advanced  Practice Nursing Act, the Illinois      
   Optometric Practice Act of 1987, and the  Podiatric  Medical  Practice      
   Act  of  1987  to  make  changes  in  provisions concerning continuing      
   education.
