House Sponsors: RYDER-RUTHERFORD. Short description: ELECTRONIC SIGNATURE Synopsis of Bill as introduced: Amends the Electronic Commerce Security Act. Provides that the Act does not apply to transactions subject to certain provisions of the Uniform Commercial Code. Establishes rules applicable to changes or errors occurring in an electronic transmission. Establishes rules for automated transactions. HOUSE AMENDMENT NO. 1. Adds reference to: 5 ILCS 175/5-123 new Provides that notices of termination of utility services, termination of rights relating to a primary residence, cancellation of insurance benefits, recall of products, and documents required to accompany transportation or handling of hazardous material must be given in writing if those notices are required by State or federal law to be provided to a consumer after the consummation of a consumer transaction. Provides that certain provisions of the Electronic Signatures in Global and National Commerce Act are adopted as a part of the Electronic Commerce Security Act. HOUSE AMENDMENT NO. 2. Deletes reference to: 5 ILCS 175/5-123 new Replaces everything after the enacting clause. Reinserts the bill as introduced. Provides that notices relating to utility service, real estate, insurance benefits, product recalls, and hazardous materials must be in writing.
