Short description: 
DCCA-ENRGY ASSIST-CIRCT BREAKR                                             

Synopsis of Bill as introduced:
        Amends the Energy Assistance Act of 1989 and the Senior  Citizens      
   and Disabled Persons Property Tax Relief and Pharmaceutical Assistance      
   Act.  Provides  that  a  person  who  either  (i)  has been determined      
   eligible for a grant or pharmaceutical  assistance  under  the  Senior      
   Citizens  and  Disabled Persons Property Tax Relief and Pharmaceutical      
   Assistance ("Circuit Breaker") Act or (ii)  has  an  annual  household      
   income  of less than $40,000 and either is 65 years of age or older or      
   is a disabled person as defined in that Act is eligible for assistance      
   under  the  Energy  Assistance  Act  of  1999.   (Under  current  law,      
   eligibility is based on an annual  income  eligibility  limit  set  by      
   DCCA, which may not be higher than 150% of the federal poverty level.)      
   Provides  that  persons  eligible  under the "Circuit Breaker" Act are      
   automatically entitled to energy assistance without having to  file  a      
   separate  application.   Requires  the Department of Revenue to supply      
   DCCA with a list of all persons determined eligible under the "Circuit      
   Breaker" Act.  Effective immediately.                                       
        HOUSE AMENDMENT NO. 1.                                                 
        In the Energy Assistance Act of 1989, deletes language providing       
   that any person with an annual household income of less than $40,000        
   and who is either 65 years of age or a disabled person is eligible to       
   apply for assistance. Restores language providing that a person whose       
   household income is not greater than an amount determined annually by       
   the Department, in consultation with the Policy Advisory Council, may       
   apply for assistance, and that, in setting the annual eligibility           
   level, the Department shall consider the amount of available funding        
   and may not set a limit higher than 150% of the federal nonfarm             
   poverty level.
