SYVERSON. (BELLOCK) 305 ILCS 5/5-5 from Ch. 23, par. 5-5 305 ILCS 5/12-4.25 from Ch. 23, par. 12-4.25 Amends the Illinois Public Aid Code. Provides that enrollment of a vendor that provides medical transportation under the Medicaid program shall be conditional for 180 days and may be terminated without cause. Provides that if a vendor has been terminated from participation in the Medicaid program due to fraud, the vendor may be barred from participation for a longer period. Provides that if the Department of Public Aid establishes through an administrative hearing that overpayments to a vendor resulted from the vendor knowingly or through gross negligence making, or causing to be made, a false statement or misrepresentation of a material fact in connection with billings and payments under the Medicaid program, the Department may recover interest on the amount of the overpayments at the rate of 5% per annum. With respect to Medicaid payments withheld from a vendor, provides for a vendor's request for full or partial release of the withheld payments, and requires the Department of Public Aid to complete proceedings in a timely manner. Effective immediately. SENATE AMENDMENT NO. 1. Deletes everything. Amends the Illinois Public Aid Code with provisions substantially similar to those of the bill as introduced, with changes that include the following: (1) limits application of the conditional 180-day enrollment of vendors providing medical transportation to vendors providing non-emergency medical transportation, as defined by the Department of Public Aid by rule; (2) provides that termination of a vendor's participation is not subject to the Department's hearing process (instead of not subject to particular statutory notice and hearing requirements); (3) provides for recovery of interest on overpayments if a vendor willfully (instead of knowingly or through gross negligence) makes a false statement or misrepresentation in connection with billings and payments; (4) removes provisions for recovery of interest on overpayments if the overpayments resulted from the provision of services by an individual or entity that was ineligible to provide services under the Medicaid program; and (5) provides that vendors of non-emergency medical transportation services must submit to a fingerprint-based criminal background check and may be required to post a surety bond.
