   SIEBEN-HENDON-SMITH-MADIGAN,L, VIVERITO AND OBAMA.

(REITZ-FRANKS-GARRETT-HOFFMAN-DAVIS,MONIQUE)

   815 ILCS 413/25                                                             

        Amends the Telephone Solicitations Act.  Provides that  it  is  a      
   violation  of  the  Act  to  make  or  cause  to  be  made a telephone      
   solicitation call to any cellular  phone.   Effective  on  January  1,      
   2003.                                                                       
        SENATE AMENDMENT NO. 1.                                                
        Deletes everything after the enacting clause.  Reinserts text  of      
   original  bill.   Provides  that  it  is  a violation of the Telephone      
   Solicitations Act to make or cause to be made a telephone solicitation      
   call to any cellular phone unless the solicitor knows that the  person      
   receiving  the  call  will  not  have  to  pay any charges or fees for      
   receiving the call. Effective January 1, 2003.

          Fiscal impact is unknown, but is not believed to be measurable.      
        HOUSE AMENDMENT NO. 1.                                                 
        Provides that it is a violation of  the  Telephone  Solicitations      
   Act  to  knowingly  make or knowingly cause to be made, rather than to      
   make or to cause to be made, a  telephone  solicitation  call  to  any      
   cellular  phone  unless  the solicitor knows that the person receiving      
   the call will not have to pay any charges or fees  for  receiving  the      
   call.                                                                       
        HOUSE AMENDMENT NO. 2.                                                 
          Adds reference to:                                                   
          220 ILCS 5/5-109                from Ch. 111 2/3, par. 5-109         
        Amends the Public Utilities Act.  Exempts commercial mobile radio      
   service (cell-phone) providers from  certain  reporting  requirements.      
   Also  exempts  them  from the requirement that all reports made to the      
   Commission shall be open to public  inspection.    Includes  technical      
   corrections.
