   730 ILCS 5/3-7-2.5 new                                                      

        Amends the Unified Code of Corrections.  Provides that any person      
   employed by the Department of Corrections who tests positive  for  any      
   substance  prohibited  by  the  Cannabis  Control  Act or the Illinois      
   Controlled  Substances  Act  shall  be  discharged  from   employment.      
   Provides that testing shall be conducted in accordance with procedures      
   for  drug  testing  established  by  the Department including, but not      
   limited to, random, reasonable suspicion, and vehicular  post-accident      
   drug  testing.   Provides that failure to submit to a drug test by any      
   person employed by the Department shall be  construed  as  a  positive      
   test,  and  the  person  shall be discharged from employment. Provides      
   that any person employed by the Department who  is  discharged  for  a      
   positive  drug  test  or  for failure to submit to a test shall not be      
   eligible for rehire.  Effective immediately.                                
        SENATE AMENDMENT NO. 1.                                                
          Adds reference to:                                                   
          20 ILCS 2610/12.5 new                                                
        Deletes everything.  Amends the State Police Act.  Provides  that      
   any  person  employed  by  the  Department  of  State Police who tests      
   positive for any  substance  prohibited  by  the  Illinois  Controlled      
   Substances  Act  or  the Cannabis Control Act shall be discharged from      
   employment.  Amends the Unified Code of  Corrections.   Provides  that      
   any  person  employed  by  the  Department  of  Corrections  who tests      
   positive for any  substance  prohibited  by  the  Illinois  Controlled      
   Substances  Act  or  the Cannabis Control Act shall be discharged from      
   employment.  Requires all samples used for drug testing purposes to be      
   collected by persons who have at least 40 hours of initial training in      
   the proper collection procedures  and  at  least  8  hours  of  annual      
   follow-up  training  and  also requires these persons to be trained in      
   the appropriate interpersonal skills required  during  the  collection      
   process.   Provides  that  an  employee discharged for a positive test      
   shall not be eligible for rehire.
