(SOTO-MILLER-YOUNGE-YARBROUGH-BOLAND) 820 ILCS 160/2 from Ch. 48, par. 39x Amends provisions of the Employee Benefit Contribution Act requiring an employer that has agreed to make payments to an employee health insurance plan to notify its employees of any failure to make payments if the failure may result in the loss of insurance coverage. Provides that the employer must mail the notification directly to each of its employees who are covered under the plan. Deletes language providing that notification may be made by posting in a conspicuous place in the place of employment and that the Department of Insurance has authority to inspect places of employment for the purpose of assuring the employer's compliance with the notification requirements. SENATE AMENDMENT NO. 1. Provides that an employer that has agreed to make payments to an employee health insurance plan shall notify its employees of any failure to make the payments if the failure to make the payments "shall result" (rather than "may result") in the "total loss" (rather than "loss") of insurance coverage. Provides that the employer must "provide written notification" (rather than "mail the notification") directly to each employee who is covered under the plan.
