SOTO-YARBROUGH-DELGADO-MCGUIRE-BOLAND AND HOWARD.

   New Act                                                                     
   30 ILCS 500/20-17 new                                                       

        Creates the Illinois Living  Wage  Act.   Provides  that  certain      
   employers  must  pay  employees  a living wage rate that is set by the      
   Director of Labor. Requires employers to provide continued  employment      
   to  certain employees when a contract provides for the continuation of      
   services currently provided by another contractor.  Requires employers      
   to post notice  of  employee's  rights  under  the  Act.   Allows  the      
   Director  to  investigate  violations  of the Act.  Sets penalties for      
   violations of the Act.  Prohibits retaliation  against  employees  who      
   exercise  their rights under the Act.  Amends the Illinois Procurement      
   Code.  Requires the procurement officer to determine the level of  the      
   State's  vulnerability  to labor unrest before issuing invitations for      
   bids or requests for proposals for service contracts.  Requires  those      
   bids  and  proposals  to  (i)  include assurance of protection against      
   labor discord and (ii) certify that the contractor  will  comply  with      
   the Illinois Living Wage Act.  Provides that if during the duration of      
   the  contract,  a  contractor fails to comply with the Illinois Living      
   Wage Act, the contract is voidable.  Effective January 1, 2003.

          Total cost associated with additional staffing and funds for         
          printing/mailing costs associated with the required postings         
          is $244,100.

          In the opinion of DCCA, HB 5626 creates a personnel mandate for      
          which reimbursement of 100% of the increased costs to local          
          governments is required, and a local government organization         
          and structure mandate for which reimbursement is not required        
          under the State Mandates Act. An estimate of the increased           
          costs to local governments is not available.
