   BLACK, BOST, BRADY, COWLISHAW, MITCHELL,BILL, 
   OSMOND, PANKAU, POE, RIGHTER, SCHMITZ, SOMMER, MEYER, 
   KURTZ, BIGGINS, MOFFITT, WAIT, MITCHELL,JERRY, 
   REITZ, HANNIG, HOLBROOK, FORBY, FOWLER, HOFFMAN, 
   BOLAND AND HULTGREN.

   305 ILCS 5/5-1            from Ch. 23, par. 5-1                             

        Amends the Illinois Public Aid Code.  Makes a technical change in      
   a Section concerning the purpose of the "Medicaid" Article.                 
        HOUSE AMENDMENT NO. 1.                                                 
          Deletes reference to:                                                
          305 ILCS 5/5-1                                                       
          Adds reference to:                                                   
          305 ILCS 5/5-5.4                                                     
        Deletes everything. Amends the Illinois Public Aid Code.  Deletes      
   a provision for annual Medicaid nursing home rate  increases  in  1984      
   and  thereafter.   Provides  that  the  Department  of Public Aid must      
   implement a new Medicaid payment methodology for the nursing component      
   of the nursing home rate effective July 1,  2003,  using  the  Minimum      
   Data  Set  (MDS).  Provides for up to a 2-year period of transition to      
   the new methodology.  Provides that for a facility that would  receive      
   a  lower  nursing  component rate per patient day under the new system      
   than the facility received effective on the date immediately preceding      
   the date that the Department implements the new  payment  methodology,      
   the  rate  per  patient for the facility shall be held at the level in      
   effect on that prior date until a  higher  rate  of  reimbursement  is      
   achieved  by  that  facility.  Provides that for a facility that would      
   receive a higher  rate,  the  rate  shall  be  adjusted.   Makes  rate      
   adjustments subject to appropriations.                                      
          FISCAL NOTE, H-AM 1 (Illinois Department of Public Aid)              
          As this language provides that rates are subject to appropria-       
          tion, this bill has no fiscal impact.                                
          BALANCED BUDGET NOTE, H-AM 1 (Bureau of the Budget)                  
          Since this bill is not a supplemental appropriation bill, the        
          Balanced Budget Note Act is inapplicable.                            
          STATE DEBT NOTE, H-AM 1 (Economic and Fiscal Commission)             
          This legislation would not change the amount of authorization        
          for any type of State-issued or State-supported bond, and,           
          therefore, would not affect the level of State indebtedness.         
          STATE MANDATES NOTE, H-AM 1

          In the opinion of DCCA, HB5567 (H-am 1) does not create a State      
          mandate under the State Mandates Act. A subsequent rulemaking        
          by the Department of Public Aid would be subject to review when      
          the rules are proposed.
