ACEVEDO-MENDOZA-MILLER.

(SHADID)

   625 ILCS 5/5-401.2        from Ch. 95 1/2, par. 5-401.2                     

        Amends the Illinois Vehicle Code. Provides that a person licensed      
   or required to be licensed as a vehicle dealer  who  issues  temporary      
   registration  permits  must  electronically file the registration with      
   the Secretary of State and must maintain records of the  registration.      
   Provides  that  a  person  who  knowingly  fails  to  comply  with the      
   provision or knowingly  fails  to  comply  with  an  order  issued  in      
   accordance  with  the provision is guilty of a Class B misdemeanor for      
   the first violation and a Class  A  misdemeanor  for  the  second  and      
   subsequent  violations. Provides that a person convicted of failing to      
   keep required records with intent to conceal the identity or origin of      
   a vehicle or its essential parts or to defraud the public in the  sale      
   or  transfer of vehicles or their essential parts is guilty of a Class      
   2 felony. Provides that each  violation  constitutes  a  separate  and      
   distinct  offense.  Provides  that  the  Secretary  shall  adopt rules      
   necessary for implementation of the provision, which may  include  the      
   imposition of administrative fines. Effective immediately.

          There would be no fiscal impact from HB 4948.                        
        SENATE AMENDMENT NO. 1.                                                
        Provides that a person may not  be  criminally  charged  with  or      
   convicted of both a knowing failure to comply with the provision and a      
   knowing failure to comply with any order, if both offenses involve the      
   same record keeping violation.                                              
        SENATE AMENDMENT NO. 2.                                                
        Provides that  a  junking  certificate  number  obtained  by  the      
   licensee  shall  be  recorded  at  the  close of business of the fifth      
   (rather than the second) business day after the licensee receives  the      
   junking certificate. Provides that if the vehicle on which the junking      
   certificate  is  obtained,  or any part of that vehicle, is dismantled      
   for its parts to be disposed of in any way, or if the parts are to  be      
   used  by  the  licensee to materially alter a vehicle, those essential      
   parts shall be recorded (rather than being recorded in the record book      
   for essential parts).
