   815 ILCS 306/81 new                                                         

        Amends the Illinois Vehicle Code and the Automotive  Repair  Act.      
   Provides  that  a  dealer  selling used cars in an area subject to the      
   Vehicle Emissions Inspection Law of  1995  must  ensure  that  a  used      
   vehicle  he  or  she  sells  that  is  subject to inspection meets the      
   emission standards established under the law. Provides that  a  dealer      
   has  complied  with the law if, not more than 120 days before the date      
   of sale, the vehicle has been  subjected  to  an  inspection  and  has      
   passed  the inspection or has been granted a waiver of the exhaust gas      
   pollutant standard. Provides that if a person buys a  vehicle  subject      
   to  this  provision that has not been inspected or has not received an      
   inspection certificate or been granted a waiver, the person  may  have      
   the  vehicle  inspected  within  60  days  after the date of purchase.      
   Provides that if  the  vehicle  does  not  pass  the  inspection,  the      
   purchaser  may  return  the  vehicle  to  the dealer and obtain, at no      
   charge, the repairs necessary to allow the vehicle to pass inspection.      
   Provides that, alternatively, the purchaser may repair the vehicle, or      
   have it repaired, and, upon presenting signed and dated receipts or an      
   affidavit signed by the person who repaired the vehicle, be reimbursed      
   by the dealer for the cost of the repairs, up  to  a  total  of  $450.      
   Provides  that  the  Secretary  of  State  shall  adjust  the  maximum      
   reimbursement amount in January 2003 and in January of each succeeding      
   year  to  reflect  any increase in the consumer price index.  Provides      
   that a person  who  knowingly  violates  the  Vehicle  Code  provision      
   violates the Automotive Repair Act.
