GILES-DELGADO-JONES,LOU-MENDOZA, JONES,SHIRLEY, MILLER, YARBROUGH, DAVIS,MONIQUE AND KENNER. 730 ILCS 5/3-6-3 from Ch. 38, par. 1003-6-3 Amends the Unified Code of Corrections. Provides that a prisoner who is serving a sentence for a crime committed as a result of the use of, abuse of, or addiction to alcohol or a controlled substance shall receive no good conduct credit until he or she participates in and completes a substance abuse treatment program that is approved by the Department of Corrections. Effective immediately. CORRECTIONAL NOTE (Department of Corrections) HB 1969 would cause an increase of 13,292 inmates in the corrections population and would have a fiscal impact of $2,543,025,700. FISCAL NOTE (Department of Corrections) Same as correctional note. HOUSE AMENDMENT NO. 1. Further amends the Unified Code of Corrections concerning good conduct credit. Provides that, for a prisoner who is serving a sentence for a crime committed as a result of the use of, abuse of, or addiction to alcohol or a controlled substance, if he or she participates in and completes a substance abuse treatment program, the Department may award good conduct credit for the time spent in treatment. Provides that availability of substance abuse treatment shall be subject to the limits of fiscal resources appropriated by the General Assembly for these purposes. Provides that if treatment is not available, prisoners shall be placed on a waiting list under criteria established by the Department. Provides that the Department may require a prisoner placed on a waiting list to attend a substance abuse education class or attend substance abuse self-help meetings. Provides that prisoners shall not lose good conduct credit as a result of being placed on a waiting list and shall remain eligible for increased good conduct credit for participation in educational, vocational, and correctional industry programs. Replaces the immediate effective date with an effective date of January 1, 2002.
