PARKE. 820 ILCS 305/3.5 new Amends the Workers' Compensation Act to provide that if an employee had a blood alcohol content of 0.08 or more or had cannabis or a controlled substance (that had been unlawfully used) in his or her body at the time he or she became injured or disabled, the arbitrator shall take that information into consideration in determining whether to recommend workers' compensation for the employee to the Industrial Commission.
