HOFFMAN. 745 ILCS 10/3-105 from Ch. 85, par. 3-105 Amends the Local Governmental and Governmental Employees Tort Immunity Act. Replaces provisions concerning a local public entity's duty to exercise ordinary care in the maintenance of its property. Provides that neither a local public entity nor a public employee or agent of the local public entity, nor any other person engaged by the local public entity, public employee, or agent, who removes or attempts to remove snow or ice from a street, sidewalk, or other public way is liable for any injury that results from a condition caused by that undertaking unless the alleged misconduct was willful and wanton. (Current law provides that nothing in the Section concerning liability for the use of streets and public ways relieves a local public entity of the duty to exercise ordinary care in the maintenance of its property.) Effective immediately. FISCAL NOTE (Administrative Office of the Illinois Courts) HB 815 would have no fiscal impact on the judicial branch.
