(SILVERSTEIN) 720 ILCS 5/9-3 from Ch. 38, par. 9-3 Amends the Criminal Code of 1961. Includes in the definition of "being under the influence" for purpose of the reckless homicide statute, being under the influence of an intoxicating compound or combination of intoxicating compounds to a degree that renders the person incapable of safely driving a motor vehicle or operating a snowmobile, all-terrain vehicle, or watercraft or having an amount of a drug, substance, or compound in the person's breath, blood, or urine resulting from the unlawful use or consumption of cannabis or a controlled substance, or of an intoxicating compound listed in the Use of Intoxicating Compounds Act. Increases the penalty for reckless homicide in which the defendant was under the influence of alcohol or other drugs from a Class 2 felony to a Class 1 felony. Increases the term of imprisonment that may be imposed in these cases from not less than 3 years and not more than 14 years to not less than 4 years and not more than 30 years. If the defendant kills 2 or more individuals as part of a single course of conduct, increases the term of imprisonment that may be imposed from not less than 6 years and not more than 28 years to not less than 8 years and not more than 60 years. Effective immediately. HOUSE AMENDMENT NO. 1. Deletes the additional changes to the definition of a person being considered to be under the influence of alcohol or other drugs.
