ACEVEDO-BRADLEY. (MUNOZ) 305 ILCS 20/6 from Ch. 111 2/3, par. 1406 Amends the Energy Assistance Act of 1989. Provides for a maximum income eligibility level of 150% of the federal poverty guideline for nonfarm families or 60% of the State median income, whichever results in the larger number of persons eligible for assistance. (Under current law, the maximum level is 150% of the federal nonfarm poverty level.) Effective immediately. HOUSE AMENDMENT NO. 1. Deletes everything. Amends the Energy Assistance Act of 1989. Provides for a maximum income eligibility level equal to that specified in federal statutes concerning low-income home energy assistance (currently the greater of 150% of the federal poverty level or 60% of the State median income), instead of a maximum level determined annually by DCCA. Requires DCCA to set the eligibility level at the level that results in the largest number of persons eligible for assistance if federal law authorizes more than one maximum household income level. (Under current law, the maximim level is set by the Department but may not exceed 150% of the federal nonfarm poverty level.) Effective immediately. FISCAL NOTE, H-AM 1 (Department of Commerce and Community Affairs) This legislation has no fiscal impact on DCCA at this time. HOUSE AMENDMENT NO. 2. Deletes everything. Amends the Energy Assistance Act of 1989. Restores provision for a maximum income eligibility level determined annually by DCCA. Provides that DCCA may not set an income eligibility limit higher than the household income level established pursuant to federal law concerning low-income home energy assistance (instead of not higher than 150% of the federal nonfarm poverty level). Provides that if federal law authorizes more than one maximum household income level, the Department may set the eligibility level at the level that results in the largest number of persons eligible for assistance. Effective immediately.
