(DILLARD-OBAMA-HENDON-LAUZEN) 625 ILCS 5/16-108 new Amends the Illinois Vehicle Code. Provides that whenever a peace officer stops a vehicle for a traffic violation, the officer shall record and report racial, age, and gender information on the individual stopped and the reasons for and the results of the stop. Provides that each law enforcement agency shall compile the required data and submit the data in an annual report to the Attorney General. Provides that the Attorney General shall analyze the data and submit a report of his findings to the General Assembly. Provides that law enforcement agencies shall adopt policies that discourage race-based traffic stops. Provides that the Governor may direct the Comptroller and the State Treasurer to withhold State funds appropriated to a law enforcement agency that fails to comply with these requirements. Effective immediately. STATE MANDATES NOTE (Dept. of Commerce and Community Affairs) In the opinion of DCCA, HB 335 creates a local government organization and structure mandate for which reimbursement by the State is not required, a service mandate for which 50% to 100% of the increased costs to units of local government is required, and a personnel mandate for which 100% of the increased costs to units of local government is required under the State Mandates Act. HOUSE AMENDMENT NO. 4. Establishes a December 31, 2003 expiration date for the language requiring peace officers who stop vehicles for traffic violations to record and report racial, age, and gender information on the individuals stopped and to compile the data on the stops into annual reports. Provides that the Secretary of State (rather than the Attorney General) shall receive the annual reports and shall analyze the data and submit annual reports of findings. Provides that the annual reports to the Secretary of State must be submitted no later than March 1 in 2003 and 2004. Provides that the Secretary of State's annual reports of findings must be submitted no later than June 1 in 2003 and 2004. Changes the effective date to January 1, 2002. SENATE AMENDMENT NO. 1. Deletes reference to: 625 ILCS 5/16-108 new Adds reference to: 625 ILCS 5/4-102 from Ch. 95 1/2, par. 4-102 Deletes everything. Amends the Illinois Vehicle Code.
