HOWARD-DAVIS,MONIQUE-SOTO-MURPHY, TURNER,ART, 
   JONES,LOU, MORROW, YARBROUGH, DELGADO, YOUNGE, FLOWERS AND GILES.

   20 ILCS 2630/5            from Ch. 38, par. 206-5                           

        Amends the Criminal Identification Act.  Provides  for  automatic      
   expungement  and  sealing  of  certain  arrest  and conviction records      
   without the filing of a  petition  to  a  court.   Provides  that  the      
   arrest,  conviction,  and  court  records  of  a  person  who has been      
   convicted of a misdemeanor are expunged and sealed after completion of      
   his or her sentence, provided that the person has not  been  convicted      
   of  a  felony  or  misdemeanor  within the previous 2 years, excluding      
   non-DUI traffic violations and any time served in jail by  the  person      
   and   included   as   a  part  of  the  original  sentence.  Effective      
   immediately.                                                                
          FISCAL NOTE (Office of the Illinois Courts)                          
          HB301 would have limited fiscal impact on the judicial branch        
          at the State level, but compliance with the provisions of            
          HB301 would require additional resources for the Circuit             
          Courts.

          It is not anticipated that the bill would increase the number        
          of judges needed in the State.                                       
        HOUSE AMENDMENT NO. 1.                                                 
        Deletes everything after the enacting clause. Amends the Criminal      
   Identification Act. Provides that for employment application  purposes      
   only,  misdemeanor  convictions  are  automatically expunged 12 months      
   after completion of a sentence.  Does not apply to DUI violations, sex      
   offenses,  weapons  offenses,  and  crimes  of  violence.    Effective      
   immediately.                                                                
          FISCAL NOTE, H-AM 1 (Office of the Illinois Courts)                  
          House Bill 301, as amended, would have a significant fiscal          
          impact on the circuit courts. The number of cases that would be      
          affected by the bill would be in the hundreds of thousands           
          annually on a statewide basis. The actural cost of compliance        
          cannot be determined until procedures for implementing the new       
          provisions in the bill are developed.                                
          JUDICIAL NOTE, H-AM 1 (Office of the Illinois Courts)                
          House Bill 301, as amended, will increase judicial workloads.        
          However, it is not possible to determine whether the bill would      
          increase the number of judges needed in the State.
