 1        AN ACT with regard to schools.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.   The  School  Code  is  amended  by changing
 5    Section 10-22.18 as follows:

 6        (105 ILCS 5/10-22.18) (from Ch. 122, par. 10-22.18)
 7        Sec. 10-22.18.  Kindergartens. To establish kindergartens
 8    for the instruction of children between the ages of 4  and  6
 9    years,  if in their judgment the public interest requires it,
10    and to pay the necessary expenses thereof out of  the  school
11    funds  of the district.  Upon petition of at least 50 parents
12    or guardians of  children  between  the  ages  of  4  and  6,
13    residing  within  any  school district and within one mile of
14    the public school where such kindergarten is proposed  to  be
15    established,  the  board  of  directors  shall,  if funds are
16    available, establish a kindergarten in  connection  with  the
17    public  school  designated in the petition and maintain it as
18    long as the annual average daily attendance  therein  is  not
19    less  than  15.  If  a kindergarten is established, the board
20    must offer both may establish a  kindergarten  with  half-day
21    attendance  kindergarten  and  or  with  full-day  attendance
22    kindergarten.     If    the    board   establishes   full-day
23    kindergarten, it shall also establish half-day  kindergarten.
24    No  one shall be employed to teach in a kindergarten who does
25    not hold a certificate as provided by law.

28        Section 10. The  School  Code  is  amended  by  repealing
29    Section 10-20.19a.

 1        Section  90.  The State Mandates Act is amended by adding
 2    Section 8.26 as follows:

 3        (30 ILCS 805/8.26 new)
 4        Sec. 8.26. Exempt mandate.   Notwithstanding  Sections  6
 5    and  8 of this Act, no reimbursement by the State is required
 6    for  the  implementation  of  any  mandate  created  by  this
 7    amendatory Act of the 92nd General Assembly.

 8        Section 99.  Effective date.  This Act  takes  effect  on
 9    July 1, 2002.
