1 AN ACT concerning State finance.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The State Finance Act is amended by adding
5 Sections 5.570 and 6z-60 as follows:

7 Sec. 5.570. The Road Fees Refund Fund.
8 (30 ILCS 105/6z-60 new)
9 Sec. 6z-60. Road Fees Refund Fund.
10 (a) There is created in the State treasury a special
11 fund to be known as the Road Fees Refund Fund. The
12 Comptroller and the Treasurer shall transfer $250,000 from
13 the Road Fund into the Road Fees Refund Fund each month.
14 Beginning July 1, 2002, transfers shall be made on the first
15 business day of each month. Moneys deposited into the Fund
16 may be used by the Secretary of State for refunds due to
17 overpayment or erroneous payment of Road Fund fees in
18 accordance with Section 2-119 of the Illinois Vehicle Code.
19 Within a reasonable time after the 30th day of June of each
20 year, the Secretary of State shall direct and the Comptroller
21 shall order transferred to the Road Fund all remaining
22 amounts in the Fund in excess of $250,000 as of June 30.
23 (b) This amendatory Act of the 92nd General Assembly
24 shall constitute an irrevocable and continuing appropriation
25 from the Road Fees Refund Fund for the purpose of paying
26 refunds upon the order of the Secretary of State in
27 accordance with the provisions of this Section.
28 Section 99. Effective date. This Act takes effect July
29 1, 2002.
