1 AN ACT concerning telecommunications carriers.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Public Utilities Act is amended by adding
5 Section 13-517 as follows:
6 (220 ILCS 5/13-517 new)
7 Sec. 13-517. Violation of service standards; penalty.
8 (a) Each calendar year, a telecommunications carrier
9 certificated to provide intra-exchange service must file 3
10 reports with the Commission disclosing whether or not the
11 carrier is in compliance with any applicable standards of
12 service for local exchange telecommunications carriers
13 established by Commission rule or order. The reports must be
14 filed on or before April 30, August 31, and December 31.
15 (b) The first time during a year a telecommunications
16 carrier is not in compliance with those standards when a
17 report is filed the carrier must pay to the Commission a
18 penalty of $10,000,000. The second time during a year a
19 telecommunications carrier is not in compliance with those
20 standards when a report is filed the carrier must pay to the
21 Commission a penalty of $10,000,000. The third time during a
22 year a telecommunications carrier is not in compliance with
23 those standards when a report is filed the carrier must pay
24 to the Commission a penalty of $20,000,000.
25 (c) This Section does not apply to a local exchange
26 telecommunications carrier with no more than 35,000 access
27 lines.
28 (d) The Commission may enforce this Section in the
29 manner provided in Article X of this Act.
30 Section 99. Effective date. This Act takes effect
