 1        AN ACT concerning environmental protection.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The  Environmental Protection Act is amended
 5    by changing Section 57 as follows:

 6        (415 ILCS 5/57)
 7        Sec. 57. Intent and purpose. This Title  shall  be  known
 8    and  may  be  cited  as  the Leaking Underground Storage Tank
 9    Program (LUST).  The purpose of this Title is, in  accordance
10    with  the  requirements  of  the  Hazardous  and  Solid Waste
11    Amendments of 1984 of the Resource Conservation and  Recovery
12    Act  of  1976  and in accordance with the State's interest in
13    the protection of Illinois' land and water resources: (1)  to
14    adopt  procedures  for the remediation of underground storage
15    tank  sites  due  to  the  release  of  petroleum  and  other
16    substances  regulated   under   this   Title   from   certain
17    underground  storage  tanks  or  related tank systems; (2) to
18    establish and provide procedures for  a  Leaking  Underground
19    Storage  Tank  Program  which  will  oversee  and  review any
20    remediation required for leaking underground  storage  tanks,
21    and  administer  the  Underground  Storage  Tank Fund; (3) to
22    establish an Underground Storage Tank Fund intended to  be  a
23    State  fund  by  which  persons who qualify for access to the
24    Underground Storage  Tank  Fund  may  satisfy  the  financial
25    responsibility  requirements  under  applicable State law and
26    regulations;  (4)  to  establish  requirements  for  eligible
27    owners and operators of underground  storage  tanks  to  seek
28    payment   for   any   costs  associated  with  physical  soil
29    classification,     groundwater      investigation,      site
30    classification  and  corrective  action  from the Underground
31    Storage Tank Fund; and (5) to audit  and  approve  corrective

 1    action efforts performed by Licensed Professional Engineers.
