 1                    AMENDMENT TO SENATE BILL 846

 2        AMENDMENT NO.     .  Amend Senate Bill  846  on  page  1,
 3    immediately below line 3, by inserting the following:

 4        "Section  3.   The  Department  of Commerce and Community
 5    Affairs Law of the Civil Administrative Code of  Illinois  is
 6    amended by changing Section 605-75 as follows:

 7        (20 ILCS 605/605-75)
 8        Sec. 605-75. Keep Illinois Beautiful.
 9        (a)  There is created the Keep Illinois Beautiful Program
10    Advisory  Board  consisting  of  7  members  appointed by the
11    Director of Commerce and Community Affairs.  Of  those  7,  4
12    shall be appointed from a list of at least 10 names submitted
13    by  the  boards  of  directors  from  the  various  certified
14    community  programs.   Each  certified  community program may
15    submit only  one  recommendation  to  be  considered  by  the
16    Director.   The Director of Commerce and Community Affairs or
17    his or her designee shall be a member and serve as  Chairman.
18    The  Board  shall meet at least annually at the discretion of
19    the Chairman and at such other times as the Chairman or any 4
20    members consider necessary.  Four members shall constitute  a
21    quorum.
22        (b)  The  purpose  of  the Board shall be to assist local

 1    governments and community organizations in:
 2             (1)  Educating  the  public  about  the   need   for
 3        recycling and reducing solid waste.
 4             (2)  Promoting  the  establishment  of recycling and
 5        programs that reduce litter and other solid waste through
 6        re-use and diversion.
 7             (3)  Developing local markets for recycled products.
 8             (4)  Cooperating with other State agencies and  with
 9        local governments having environmental responsibilities.
10             (5)  Seeking    funding    from   governmental   and
11        non-governmental sources.
12             (6)  Beautification projects.
13        (c)  The Department of  Commerce  and  Community  Affairs
14    shall  assist  local  governments and community organizations
15    that plan to implement programs set forth in subsection  (b).
16    The   Department   shall   establish   guidelines   for   the
17    certification    of    local    governments   and   community
18    organizations.
19        The  Department  may  encourage  local  governments   and
20    community   organizations   to  apply  for  certification  of
21    programs by the Board.  However, the  Department  shall  give
22    equal  consideration  to  newly  certified programs and older
23    certified programs.
24        (d)  The Keep Illinois Beautiful Fund  is  created  as  a
25    special  fund  in the State treasury.  Moneys from any public
26    or private source may be deposited  into  the  Keep  Illinois
27    Beautiful  Fund.   Moneys in the Keep Illinois Beautiful Fund
28    shall be appropriated only for the purposes of this  Section.
29    Pursuant  to  action by the Board, the Department of Commerce
30    and  Community  Affairs  may  authorize  grants  from  moneys
31    appropriated  from  the  Keep  Illinois  Beautiful  Fund  for
32    certified community based programs for up to 50% of the  cash
33    needs  of  the  program;  provided,  that at least 50% of the
34    needs of the program shall be contributed to the  program  in

 1    cash, and not in kind, by local sources.
 2        Moneys   appropriated   for   certified  community  based
 3    programs in municipalities of more than 1,000,000  population
 4    shall  be itemized separately and may not be disbursed to any
 5    other community.
 6        (e)  On the effective date of this amendatory Act of  the
 7    91st General Assembly, the Lieutenant Governor shall transfer
 8    to  the Department of Commerce and Community Affairs, and the
 9    Department shall receive, all assets and  property  possessed
10    by  the  Lieutenant  Governor  under  this  Section  and  all
11    liabilities and obligations for which the Lieutenant Governor
12    was   responsible   under  this  Section.   Nothing  in  this
13    subsection affects the validity of certifications and  grants
14    issued  under  this Section before the effective date of this
15    amendatory Act of the 91st General Assembly.
