 1        AN ACT in relation to child care.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The Child Care Act  of  1969  is  amended  by
 5    changing Section 2.17 as follows:

 6        (225 ILCS 10/2.17) (from Ch. 23, par. 2212.17)
 7        Sec.  2.17.  "Foster  family  home"  means a facility for
 8    child care in residences of families who receive no more than
 9    8 children unrelated to them, unless all the children are  of
10    common  parentage,  or residences of relatives who receive no
11    more than 8 related children placed by the Department, unless
12    the children are of common  parentage,  for  the  purpose  of
13    providing  family  care  and  training  for the children on a
14    full-time basis, except the Director of Children  and  Family
15    Services,  pursuant  to Department regulations, may waive the
16    limit of 8 children unrelated to an adoptive family for  good
17    cause  and  only  to  facilitate  an  adoptive placement. The
18    family's or relative's own children, under 18 years  of  age,
19    shall  be  included  in  determining  the  maximum  number of
20    children served. For purposes of this Section,  a  "relative"
21    includes  any person, 21 years of age or over, other than the
22    parent, who (i) is currently related to the child in  any  of
23    the   following  ways  by  blood  or  adoption:  grandparent,
24    sibling, great-grandparent, uncle, aunt, nephew, niece, first
25    cousin, great-uncle, or great-aunt; or (ii) is the spouse  of
26    such   a   relative;  or  (iii)  is  a  child's  step-father,
27    step-mother, or adult step-brother or step-sister; "relative"
28    also includes a person related in any of the  foregoing  ways
29    to  a  sibling  of  a  child,  even  though the person is not
30    related to the child, when the  child  and  its  sibling  are
31    placed  together  with  that  person. The term "foster family

 1    home"   includes   homes   receiving   children   from    any
 2    State-operated institution for child care; or from any agency
 3    established  by a municipality or other political subdivision
 4    of the State of  Illinois  authorized  to  provide  care  for
 5    children  outside  their  own  homes. The term "foster family
 6    home" does not include an "adoption-only home" as defined  in
 7    Section  2.23  of this Act.  The types of foster family homes
 8    are defined as follows:
 9        (a)  "Boarding home" means a  foster  family  home  which
10    receives  payment  for  regular  full-time care of a child or
11    children.
12        (b)  "Free home" means a foster family home other than an
13    adoptive home which does not receive payments for the care of
14    a child or children.
15        (c)  "Adoptive home" means a  foster  family  home  which
16    receives  a child or children for the purpose of adopting the
17    child or children.
18        (d)  "Work-wage home" means a foster  family  home  which
19    receives  a  child  or  children who pay part or all of their
20    board by rendering some services to the family not prohibited
21    by the Child Labor Law or by standards or regulations of  the
22    Department  prescribed  under this Act. The child or children
23    may receive a wage in connection with the  services  rendered
24    the foster family.
25        (e)  "Agency-supervised  home" means a foster family home
26    under the direct and regular supervision of a licensed  child
27    welfare  agency,  of  the  Department  of Children and Family
28    Services, of a circuit court, or of any  other  State  agency
29    which   has   authority  to  place  children  in  child  care
30    facilities, and which  receives  no  more  than  8  children,
31    unless  of common parentage, who are placed and are regularly
32    supervised by one of the specified agencies.
33        (f)  "Independent home" means a foster family home, other
34    than  an  adoptive  home,  which  receives  no  more  than  4

 1    children, unless of common parentage, directly from  parents,
 2    or   other   legally   responsible  persons,  by  independent
 3    arrangement and which is not subject to  direct  and  regular
 4    supervision  of a specified agency except as such supervision
 5    pertains to licensing by the Department.

 8        Sec. 2.23.  "Adoption-only home" means a family home that
 9    receives only children whose parents'  parental  rights  have
10    been  terminated  or  surrendered for the purpose of adoption
11    only.
