 1        AN ACT to amend the School Code.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The School Code is amended by adding Sections
 5    10-20.35 and 34-18.22 as follows:

 6        (105 ILCS 5/10-20.35 new)
 7        Sec. 10-20.35.  Special security officers.
 8        (a)  A   school   board   may  appoint  special  security
 9    officers,  who  have  been   recommended   by   the   general
10    superintendent,  for  the protection and safety of the school
11    district's personnel, property, students, and visitors.   The
12    board  shall  assign  duties  to  these  officers,  including
13    without  limitation  the  enforcement  of laws and rules, and
14    prescribe the oath of office.  Each of these  officers  shall
15    receive salary only from the board.
16        (b)  Before  entering  into the performance of his or her
17    duties,  a  special  security  officer   shall   successfully
18    complete the Minimum Standards Basic Law Enforcement Training
19    Course  offered at a police training school established under
20    the Illinois Police Training Act.  A special security officer
21    shall have the powers of a peace officer, including the power
22    to make an  arrest  under  the  circumstances  prescribed  in
23    Section 107-2 of the Code of Criminal Procedure of 1963 for a
24    violation  of  law.   However,  these powers may be exercised
25    only on school  district  property  for  the  protection  and
26    safety  of school district personnel, students, and visitors,
27    their property, and the  property  of  the  school  district,
28    except  that  an  officer  shall  have  the power to arrest a
29    person off school district property if that  person  violates
30    any  law  while  on  school  district property. The board may
31    allow a special security officer to carry a weapon  while  in

 1    the  performance of his or her official duties if the officer
 2    has satisfactorily completed a training  program  offered  or
 3    approved  by  the Illinois Law Enforcement Training Standards
 4    Board that substantially conforms  to  standards  promulgated
 5    pursuant  to  the  Illinois Police Training Act and the Peace
 6    Officer Firearm Training Act.
 7        (c)  Before entering into the performance of his  or  her
 8    duties,  a  special  security  officer shall give an official
 9    bond, in accordance with the Official Bond Act, in the  penal
10    sum  of  $5,000,  which  bond  shall  be conditioned upon the
11    faithful performance of the officer's duties and shall  cover
12    damage  done  by  illegal act committed by the officer in the
13    performance of his or her duties. Any  person  who  has  been
14    damaged,  either  in  his  or  her  person  or  in his or her
15    property, by the unlawful act of a special  security  officer
16    may  bring  suit for redress of such wrong on the bond of the
17    officer.
