 1        AN ACT in relation to voting equipment.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The  Election  Code  is  amended  by  adding
 5    Section 1A-16 as follows:

 6        (10 ILCS 5/1A-16 new)
 7        Sec. 1A-16.  Grants for  voting  equipment.   Subject  to
 8    appropriation,  the State Board of Elections must establish a
 9    program to make grants to counties  and  boards  of  election
10    commissioners  for  the purpose of upgrading voting equipment
11    or machines.  The State Board of  Elections  must,  by  rule,
12    establish  criteria  for  the  types  of  voting equipment or
13    machines that are eligible  for  moneys  under  the  program.
14    Preference in awarding grants must be given to proposals that
15    the  Board  determines  will (i) best foster the expeditious,
16    accurate, and reliable recording  and  tabulation  of  votes;
17    (ii)  reduce  the  potential  for fraud or human error in the
18    casting and counting of votes; and  (iii)  help  ensure  fair
19    election results.
20        A  county  or a board of election commissioners may apply
21    for grant funds under this Section on any forms  and  in  any
22    format,  and  by  any  deadline,  that  the  State  Board  of
23    Elections requires.
24        The  State  Board  of Elections may accept federal moneys
25    for the purposes of this Section.
26        The State Board of Elections must report to the  Governor
27    and  the  General  Assembly on the program's effectiveness in
28    assisting counties and boards of  election  commissioners  in
29    upgrading voting equipment and machines.

30        Section  99.  Effective date.  This Act takes effect upon
