92_SB0374 LRB9205480DJmg 1 AN ACT in relation to public aid. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Public Aid Code is amended by 5 changing Section 4-1.12 as follows: 6 (305 ILCS 5/4-1.12) 7 Sec. 4-1.12. Five year limitation. 8 (a) Except as otherwise provided in this Section, no 9 assistance unit shall be eligible for a cash grant under this 10 Article if it includes an adult who has received cash 11 assistance as an adult for 60 months, whether or not 12 consecutive, after the effective date of this amendatory Act 13 of 1997. The Illinois Department may exempt individual 14 assistance units from the 60-month limitation or determine 15 circumstances under which a month or months would not count 16 towards the 60-month limitation even though the assistance 17 unit did receive cash assistance under this Article. 18 (b) Six months before the end of an assistance unit's 19 60-month limitation period, the Department shall conduct an 20 intensive casework review of the assistance unit's 21 circumstances and continued need for assistance. 22 (c) Upon the recommendation of a Department caseworker 23 following the review required under subsection (b), and based 24 on an assistance unit's hardship and good-faith efforts to 25 become self-supporting, the Department may extend the 26 60-month limitation period for additional periods of 6 27 months. 28 (Source: P.A. 90-17, eff. 7-1-97.) 29 Section 99. Effective date. This Act takes effect upon 30 becoming law.
