1 AN ACT concerning methyl tertiary butyl ether.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 1. Short title. This Act may be cited as the MTBE
5 Elimination Act.
6 Section 5. Findings. The General Assembly finds that
7 methyl tertiary butly ether (MTBE) presents substantial
8 environmental risks to the water quality in Illinois, as well
9 as to the public health, safety, and welfare of the people of
10 the State of Illinois.
11 Section 10. Definitions. As used in this Act:
12 "MTBE" means methyl tertiary butyl ether.
13 "Agency" means the Illinois Environmental Protection
14 Agency.
15 Section 15. MTBE prohibitions. Beginning 3 years after
16 the effective date of this Act, no person shall use, sell,
17 offer for sale, blend, or manufactuer MTBE as a fuel additive
18 in Illinois.
19 Section 20. Programs. The Agency is hereby directed to
20 coordinate with the United States Environmental Protection
21 Agency, other federal, state, and local governmental
22 agencies, and private entities to develop accurate and
23 improved MTBE groundwater testing methodologies and to
24 develop more efficient and cost effective remediation
25 procedures for public water supplies and sources contaminated
26 with MTBE.
27 Section 99. Effective date. This Act takes effect upon
