 1        AN ACT in relation to medical care.

 2        Be it  enacted  by  the  People  of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section 1. Short title. This Act  may  be  cited  as  the
 5    Community Health Center Expansion Act.

 6        Section 5. Definitions. In this Act:
 7        "Community  health center site" means a new physical site
 8    where a community health center will provide  primary  health
 9    care services either to a medically underserved population or
10    area or to the uninsured population of this State.
11        "Community  provider"  means a Federally Qualified Health
12    Center (FQHC) or FQHC Look-Alike (Community Health Center  or
13    health  center),  designated  as such by the Secretary of the
14    United States Department of Health and Human  Services,  that
15    operates  at  least  one  federally designated primary health
16    care delivery site in the State of Illinois.
17        "Department" means  the  Illinois  Department  of  Public
18    Health.
19        "Medically underserved area" means an urban or rural area
20    designated  by  the Secretary of the United States Department
21    of Health and Human Services as an area with  a  shortage  of
22    personal health services.
23        "Medically   underserved   population"   means   (i)  the
24    population of an  urban  or  rural  area  designated  by  the
25    Secretary of the United States Department of Health and Human
26    Services  as  an  area  with  a  shortage  of personal health
27    services  or  (ii)  a  population  group  designated  by  the
28    Secretary as having a shortage of those services.
29        "Primary health care services" means the following:
30             (1)  Basic  health  services   consisting   of   the
31        following:

 1                  (A) Health services related to family medicine,
 2             internal   medicine,   pediatrics,   obstetrics,  or
 3             gynecology that are furnished by physicians and,  if
 4             appropriate,     physician     assistants,     nurse
 5             practitioners, and nurse midwives.
 6                  (B)   Diagnostic   laboratory   and  radiologic
 7             services.
 8                  (C) Preventive health services,  including  the
 9             following:
10                       (i) Prenatal and perinatal services.
11                       (ii)  Screenings  for  breast and cervical
12                  cancer.
13                       (iii) Well-child services.
14                       (iv)         Immunizations         against
15                  vaccine-preventable diseases.
16                       (v) Screenings  for  elevated  blood  lead
17                  levels, communicable diseases, and cholesterol.
18                       (vi)   Pediatric   eye,  ear,  and  dental
19                  screenings to determine the need for vision and
20                  hearing correction and dental care.
21                       (vii) Voluntary family planning services.
22                       (viii) Preventive dental services.
23                  (D) Emergency medical services.
24                  (E) Pharmaceutical services as appropriate  for
25             particular health centers.
26             (2)  Referrals  to providers of medical services and
27        other health-related services (including substance  abuse
28        and mental health services).
29             (3)  Patient  case  management  services  (including
30        counseling,  referral,  and follow-up services) and other
31        services designed to assist  health  center  patients  in
32        establishing   eligibility  for  and  gaining  access  to
33        federal,  State,  and  local  programs  that  provide  or
34        financially support the  provision  of  medical,  social,

 1        educational, or other related services.
 2             (4)  Services  that  enable  individuals  to use the
 3        services of the health  center  (including  outreach  and
 4        transportation  services  and, if a substantial number of
 5        the  individuals  in  the  population  are   of   limited
 6        English-speaking  ability,  the  services  of appropriate
 7        personnel fluent in the language spoken by a  predominant
 8        number of those individuals).
 9             (5) Education of patients and the general population
10        served  by  the  health center regarding the availability
11        and proper use of health services.
12             (6)  Additional  health   services   consisting   of
13        services that are appropriate to meet the health needs of
14        the  population  served by the health center involved and
15        that may include the following:
16                  (A) Environmental  health  services,  including
17             the following:
18                       (i)    Detection    and   alleviation   of
19                  unhealthful conditions  associated  with  water
20                  supply.
21                       (ii) Sewage treatment.
22                       (iii) Solid waste disposal.
23                       (iv)  Detection  and alleviation of rodent
24                  and parasite infestation.
25                       (v) Field sanitation.
26                       (vi) Housing.
27                       (vii) Other environmental factors  related
28                  to health.
29                  (B)  Special occupation-related health services
30             for migratory  and  seasonal  agricultural  workers,
31             including the following:
32                       (i)   Screening   for   and   control   of
33                  infectious    diseases,   including   parasitic
34                  diseases.

 1                       (ii) Injury prevention programs, which may
 2                  include prevention of exposure to unsafe levels
 3                  of    agricultural     chemicals,     including
 4                  pesticides.
 5        "Uninsured  population"  means  persons  who  do  not own
 6    private health care  insurance,  are  not  part  of  a  group
 7    insurance plan, and are not eligible for any State or federal
 8    government-sponsored health care program.

 9        Section 10. Grants.
10        (a)  The  Department  shall  establish a community health
11    center  expansion  grant  program  and  may  make  grants  to
12    eligible community providers subject  to  appropriations  for
13    that  purpose.   The  grants  shall be for the purpose of (i)
14    establishing new community health  center  sites  to  provide
15    primary   health   care  services  to  medically  underserved
16    populations  or  areas  as  defined  in  Section  5  or  (ii)
17    providing primary  health  care  services  to  the  uninsured
18    population of Illinois.
19        (b)  Grants  under this Section shall be for periods of 3
20    years. The Department may make new grants whenever the  total
21    amount appropriated for grants is sufficient to fund both the
22    new grants and the grants already in effect.
23        (c)  A  recipient of a grant to establish a new community
24    health center site must add each such site to the recipient's
25    established service area for the purpose of extending federal
26    FQHC or FQHC Look-Alike status to the new site in  accordance
27    with  federal  regulations. The grant recipient must complete
28    this process by the end of the second year of the grant.

29        Section 15. Eligibility for grant. To be eligible  for  a
30    grant  under  this  Act,  a  recipient  must  be  a community
31    provider as defined in Section 5 of this Act.

 1        Section 20. Use of grant moneys. A recipient of  a  grant
 2    under this Act may use the grant moneys to do any one or more
 3    of the following:
 4             (1) Purchase equipment.
 5             (2)  Acquire a new physical location for the purpose
 6        of delivering primary health care services.
 7             (3) Hire and train staff.
 8             (4) Develop new practice networks.
 9             (5)  Purchase  services  or   products   that   will
10        facilitate the provision of health care services at a new
11        community health center site.

12        Section 25. Reporting. Within 60 days after the first and
13    second  years  of a grant under this Act, the grant recipient
14    must  submit  a  progress  report  to  the  Department.   The
15    Department may assist each grant  recipient  in  meeting  the
16    goals  and  objectives  stated in the original grant proposal
17    submitted by the recipient, that grant moneys are being  used
18    for appropriate purposes, and that residents of the community
19    are  being  served  by  the new community health center sites
20    established with grant moneys.

21        Section 30.  Rules; public comment.
22        (a)  The Department shall adopt rules and regulations  it
23    deems necessary for the efficient administration of this Act.
24        (b)  The  rules shall provide for a 30-day general public
25    comment period.  Notification  of  a  30-day  general  public
26    comment  period  shall be given to the community into which a
27    grant applicant proposes to expand by publication in at least
28    one newspaper of general circulation in  that  community.  At
29    the  conclusion  of the 30-day comment period, the Department
30    shall no longer  accept  written  comments.   The  Department
31    shall  review  written comments, submitted within the comment
32    period, before awarding a grant.

 1        (c)  The  Department  shall  consider  the  contents   of
 2    written  comments  only  as  part of the overall grant review
 3    process.

 4        Section 99. Effective date. This Act  takes  effect  upon
 5    becoming law.
