 1        AN ACT in relation to property.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.   The  Code  of Civil Procedure is amended by
 5    changing Section 7-103 as follows:

 6        (735 ILCS 5/7-103) (from Ch. 110, par. 7-103)
 7        Sec. 7-103.  "Quick-take".
 8        (a)  This Section applies only to proceedings under  this
 9    Article  that  are  authorized in the Sections following this
10    Section and preceding Section 7-104.

10        (a-5)  A   unit   of   local   government   may  exercise
11    "quick-take" powers to acquire real property or  an  interest
12    in real property under this Article only with respect to real
13    property   lying   within   the  limits  of  its  territorial
14    jurisdiction. Before the General Assembly  may  consider  any
15    amendment  of  this  Section that adds an authorization for a
16    unit of local government  to  acquire  real  property  or  an
17    interest  in  real  property  under  this Section, all of the
18    following must occur:
19             (1)  A petition  requesting  authorization  for  the
20        unit  of local government to exercise "quick-take" powers
21        to acquire the property or  interest  in  property  under
22        this  Article  must  be  signed  by  at  least 10% of the
23        persons registered to vote in the  territory  subject  to
24        the  unit  of local government's jurisdiction and must be
25        filed with the clerk of the unit of local government  (in
26        the  case  of a municipality) or the county clerk (in the
27        case  of  a  unit  of  local  government  other  than   a
28        municipality).
29             (2)  After  a petition is filed under paragraph (1),
30        the governing body of the unit of local government  shall
31        then  hold  at  least one public hearing on the matter of
32        the proposed acquisition.  The governing body  must  give
33        notice  of  the  hearing  by  publication  in a newspaper
34        published in the territory under the jurisdiction of  the

 1        unit of local government or, if no newspaper is published
 2        in  that territory, in a newspaper of general circulation
 3        in that territory.  At the  hearing  the  governing  body
 4        shall  give  members  of the public an opportunity to ask
 5        questions and offer comments  orally  or  in  writing  or
 6        both.
 7             (3)  After  the  conclusion  of  the  public hearing
 8        process required under paragraph (2), and not on the same
 9        day as a hearing  conducted  under  that  paragraph,  the
10        governing  body  of  the  unit  of local government shall
11        adopt  by  recorded  vote  a  resolution  requesting   an
12        authorization  to exercise "quick-take" powers to acquire
13        the property or interest in property under this Article.
14             (4)  After adopting  a  resolution  under  paragraph
15        (3),  the  governing body of the unit of local government
16        shall file with the Secretary of the Senate and the Clerk
17        of the House of Representatives all of the following:
18                  (A)  A copy of the resolution.
19                  (B)  The legal description of the  property  or
20             interest  in  property  sought to be acquired by the
21             exercise of "quick-take" powers under this Article.
22                  (C)  An appraisal of the fair market  value  of
23             the  property  or  interest in property sought to be
24             acquired by  the  unit  of  local  government.   The
25             appraisal   must   be  prepared  by  an  independent
26             qualified real estate appraiser.
27                  (D)  An explanation of the public purposes that
28             the unit of local government intends to  further  by
29             the  acquisition  of  the  property  or  interest in
30             property.
31        The changes made by  this  amendatory  Act  of  the  92nd
32    General Assembly apply only to authorizations to acquire real
33    property  or  an interest in real property under this Section
34    that take effect after the effective date of this  amendatory

 1    Act of the 92nd General Assembly.
 2        (b)  In   a  proceeding  subject  to  this  Section,  the
 3    plaintiff, at any time after the complaint has been filed and
 4    before judgment is entered in  the  proceeding,  may  file  a
 5    written  motion  requesting  that,  immediately  or  at  some
 6    specified later date, the plaintiff either be vested with the
 7    fee   simple  title  (or  such  lesser  estate,  interest  or
 8    easement, as may  be  required)  to  the  real  property,  or
 9    specified  portion  thereof,  which  is  the  subject  of the
10    proceeding, and be authorized to take possession of  and  use
11    such  property;  or  only be authorized to take possession of
12    and to use such property, if such possession and use, without
13    the vesting of title, are sufficient to permit the  plaintiff
14    to  proceed with the project until the final ascertainment of
15    compensation; however, no land or interests  therein  now  or
16    hereafter  owned, leased, controlled or operated and used by,
17    or necessary for the actual operation of, any common  carrier
18    engaged  in  interstate commerce, or any other public utility
19    subject  to  the  jurisdiction  of  the   Illinois   Commerce
20    Commission,  shall  be taken or appropriated hereunder by the
21    State of Illinois, the Illinois Toll Highway  Authority,  the
22    sanitary  district,  the  St. Louis Metropolitan Area Airport
23    Authority or the Board  of  Trustees  of  the  University  of
24    Illinois   without   first  securing  the  approval  of  such
25    Commission.
26        Except as hereinafter stated, the motion for taking shall
27    state: (1) an accurate description of the property  to  which
28    the  motion  relates  and the estate or interest sought to be
29    acquired therein; (2) the formally adopted schedule  or  plan
30    of  operation  for  the execution of the plaintiff's project;
31    (3) the  situation  of  the  property  to  which  the  motion
32    relates,  with  respect  to  the  schedule  or  plan; (4) the
33    necessity for taking such property in the manner requested in
34    the  motion;  and  (5)  if  the  property  (except   property

 1    described in Section 3 of the Sports Stadium Act, or property
 2    described as Site B in Section 2 of the Metropolitan Pier and
 3    Exposition  Authority  Act)  to  be  taken  is owned, leased,
 4    controlled or operated and used  by,  or  necessary  for  the
 5    actual  operation  of, any interstate common carrier or other
 6    public utility subject to the jurisdiction  of  the  Illinois
 7    Commerce  Commission,  a  statement  to  the  effect that the
 8    approval of such proposed taking has been secured  from  such
 9    Commission,  and attaching to such motion a certified copy of
10    the order of such Commission granting such approval.  If  the
11    schedule  or  plan of operation is not set forth fully in the
12    motion, a copy of such schedule or plan shall be attached  to
13    the motion.
