 1                          HOUSE RESOLUTION

 2        WHEREAS, There is growing public concern for the physical
 3    health of students in the  elementary  and  secondary  public
 4    schools of this State; and

 5        WHEREAS,  There  is  evidence that physical activity is a
 6    major factor for a  healthy  lifestyle  for  our  youth  that
 7    carries into adulthood; and

 8        WHEREAS,  The  State  of Illinois has a responsibility to
 9    promote a healthy population, including the encouragement  of
10    well-balanced  physical  education  programs  in  our  public
11    schools; and

12        WHEREAS, The use of the so-called "waiver law" in Section
13    2-3.25g of the School Code has had the effect of denying many
14    students  the  opportunity  to  engage  in  and learn healthy
15    lifestyle choices; therefore be it

16        RESOLVED,  BY  THE  HOUSE  OF  REPRESENTATIVES   OF   THE
17    NINETY-SECOND GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that
18    we request the State Superintendent of Education to determine
19    if  all  school  districts seeking physical education waivers
20    comply with the following:
21             (1)  the statutory requirement to  fully  adhere  to
22        the  notice  requirements of the waiver law so that there
23        is full opportunity for the public and teaching staffs to
24        participate in public hearings; and
25             (2)  the statutory requirement to document  how  the
26        granting  of  the  waiver  will  result  in the statutory
27        requirement that a school  district  seeking  a  physical
28        education  waiver  demonstrate  that  the  district  "can
29        address  the  intent  of  the  rule  or mandate in a more
30        effective, efficient, or economical manner" or  that  the
31        waiver  is  "necessary to stimulate innovation or improve
32        student performance"; and be it further

 1        RESOLVED, That  we  urge  the  Illinois  Association  for
 2    Health,   Physical   Education,   Recreation   and  Dance  to
 3    accelerate its activities directed  to  its  members  and  to
 4    school  districts  whereby the teaching of physical education
 5    and health reflects a well-rounded  program  resulting  in  a
 6    healthier   student  body,  and  that  we  further  urge  the
 7    Association to include a description of  this  effort  in  an
 8    annual  report  filed  with  the Chairperson and the Minority
 9    Spokesperson  of  the  House  Committee  on  Elementary   and
10    Secondary  Education  on  or  before January 1, 2003 and each
11    year thereafter; and be it further

12        RESOLVED, That a suitable  copy  of  this  resolution  be
13    delivered  to  the  State Superintendent of Education and the
14    Illinois  Association   for   Health,   Physical   Education,
15    Recreation and Dance.
