 1                    AMENDMENT TO HOUSE BILL 6012

 2        AMENDMENT NO.     .  Amend House Bill 6012  by  replacing
 3    everything after the enacting clause with the following:

 4        "Section  5.  The Simplified Municipal Telecommunications
 5    Tax Act is amended by changing Section 5-5 as follows:

 6        (35 ILCS 636/5-5)

 8    delayed effective date)
 9        Sec.  5-5.   Legislative  intent.   The  Illinois General
10    Assembly has authorized  the  corporate  authorities  of  any
11    municipality   to  impose  various  fees  and  taxes  on  the
12    privilege of originating or receiving telecommunications, and
13    on retailers engaged in the  business  of  transmitting  such
14    telecommunications,   all  of  which  are  remitted  by  such
15    retailers directly to the imposing municipality. To  simplify
16    the imposition and collection of municipal telecommunications
17    taxes  and  to  reduce  complication  and burden, the General
18    Assembly is repealing the municipal  telecommunications  tax,
19    the   municipal   tax  on  the  occupation  or  privilege  of
20    transmitting  messages,  and  the  municipal   infrastructure
21    maintenance  fee,  and  is enacting this Simplified Municipal
22    Telecommunications  Tax  Act  which  provides  for  a  single

 1    municipally  imposed  telecommunications   tax   which,   for
 2    municipalities with populations of less than 500,000, will be
 3    collected  by  the Illinois Department of Revenue, but which,
 4    for municipalities of 500,000 or more, will  continue  to  be
 5    collected by such municipalities.
