 1        AN ACT in relation to vehicles.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5. The State Finance Act  is  amended  by  adding
 5    Section 5.570 as follows:

 7        Sec. 5.570. The Illinois Pan Hellenic Trust Fund.

 8        Section  10.  The  Illinois  Vehicle  Code  is amended by
 9    adding Section 3-654 as follows:

11        Sec. 3-654. Pan Hellenic license plates.
12        (a)  The Secretary, upon receipt of all  applicable  fees
13    and   applications   made  in  the  form  prescribed  by  the
14    Secretary, may issue special registration  plates  designated
15    as  Pan  Hellenic  license  plates. The special plates issued
16    under  this  Section  shall  be  affixed  only  to  passenger
17    vehicles of the first  division  or  motor  vehicles  of  the
18    second  division  weighing not more than 8,000 pounds. Plates
19    issued under this  Section  shall  expire  according  to  the
20    multi-year  procedure  established by Section 3-414.1 of this
21    Code.
22        (b)  The design and color of the special plates shall  be
23    wholly within the discretion of the Secretary, except that an
24    emblem  of  a  Pan  Hellenic  eligible member shall be on the
25    plate.  Appropriate  documentation,  as  determined  by   the
26    Secretary,  shall  accompany  each application. The Secretary
27    may, in his or her discretion, allow the plates to be  issued
28    as  vanity  or personalized plates in accordance with Section
29    3-405.1  of  this  Code.  The  plates  are  not  required  to

 1    designate "Land of Lincoln" as prescribed in  subsection  (b)
 2    of  Section  3-412 of this Code. The Secretary, in his or her
 3    discretion, may prescribe rules  governing  the  requirements
 4    and approval of the special plates.
 5        (c)  An  applicant for the special plate shall be charged
 6    a  $40  fee  for  original  issuance  in  addition   to   the
 7    appropriate  registration  fee.  Of  this  fee,  $25 shall be
 8    deposited into the Illinois Pan Hellenic Trust Fund  and  $15
 9    shall  be  deposited  into  the  Secretary  of  State Special
10    License Plate Fund, to be  used  by  the  Secretary  to  help
11    defray   the   administrative   processing  costs.  For  each
12    registration renewal period, a $27 fee, in  addition  to  the
13    appropriate  registration fee, shall be charged. Of this fee,
14    $25 shall be deposited into the Illinois Pan  Hellenic  Trust
15    Fund  and  $2  shall be deposited into the Secretary of State
16    Special License Plate Fund.
17        (d)  The Illinois Pan Hellenic Trust Fund is created as a
18    special fund in the State Treasury. The State Treasurer shall
19    create separate accounts within  the  Illinois  Pan  Hellenic
20    Trust  Fund  for  each eligible member for which Pan Hellenic
21    license plates have been issued. Moneys in the  Illinois  Pan
22    Hellenic  Trust  Fund  shall  be allocated to each account in
23    proportion to the number of plates sold  in  regard  to  each
24    fraternity  or  sorority.  All  moneys  in  the  Illinois Pan
25    Hellenic  Trust  Fund  shall  be  distributed,   subject   to
26    appropriation  by  the  General  Assembly and approval by the
27    Secretary, as  grants  to  the  Illinois  Alpha  Kappa  Alpha
28    Charitable  Foundation, Illinois Delta Sigma Theta Charitable
29    Foundation, Illinois Zeta  Phi  Beta  Charitable  Foundation,
30    Illinois  Sigma  Gamma  Rho  Charitable  Foundation, Illinois
31    Alpha Phi Alpha Charitable Foundation, Illinois Omega Psi Phi
32    Charitable Foundation, Illinois Kappa  Alpha  Psi  Charitable
33    Foundation, Illinois Phi Beta Sigma Charitable Foundation, or
34    Illinois  Iota Phi Theta Charitable Foundation for charitable

 1    purposes sponsored  by  the  African-American  fraternity  or
 2    sorority.
