 1                    AMENDMENT TO HOUSE BILL 5906

 2        AMENDMENT NO.     .  Amend House Bill 5906,  on  page  1,
 3    after line 23, by adding the following:

 4        ""Licensee" means an individual or entity licensed by the
 5    Department  to operate an end stage renal disease facility.";
 6    and

 7    on page 2, line 15, by deleting "and"; and

 8    on page 2, line  16,  after  "physician",  by  inserting  the
 9    following:

10        "; and

11        (4)  a  facility  licensed  under  the  Nursing Home Care
12    Act"; and

13    on page 3,  line  23  before  "or"  by  inserting  "physician
14    assistant, advanced practice nurse"; and

15    on   page   7,  line  32,  by  replacing  "application"  with
16    "applicant"; and

17    on page 8,  line  9,  by  replacing  "hearing  officer"  with
18    "administrative law judge" ; and

19    on  page  8,  line  14,  by  replacing "hearing officer" with

 2    on page 8, line  19,  by  replacing  "hearing  officer"  with
 3    "administrative law judge" ; and

 4    on  page  8,  line  28,  by  replacing "hearing officer" with

 6    on page 9, line  10,  by  replacing  "hearing  officer"  with
 7    "administrative law judge"; and

 8    on  page  9,  line  14,  by  replacing "hearing officer" with
 9    "administrative law judge"; and

10    on page  9,  by  replacing  lines  15  through  18  with  the
11    following:
12    "hearing  before the Department, may compel the attendance of
13    witnesses and"; and

14    on page 9, line  20,  by  replacing  "Hearing  Officer"  with
15    "administrative law judge"; and

16    on  page  9,  line  24,  by  replacing "hearing officer" with
17    "administrative law judge"; and

18    on page 10, after line 22, by adding the following:

19        "The Department shall adopt  rules  for  determining  the
20    fines for violations."; and

21    on  page  15,  by  replacing  lines  22  through  23 with the
22    following:

23        "Section 999.  Effective date.   This  Act  takes  effect
24    July 1, 2003.".
