 1                    AMENDMENT TO HOUSE BILL 5610

 2        AMENDMENT NO.     .  Amend House Bill 5610 as follows:

 3    by replacing everything after the enacting  clause  with  the
 4    following:

 5        "Section  5.  The  Illinois  Vehicle  Code  is amended by
 6    adding Sections 1-117.7 and 11-1005.1  and  changing  Section
 7    11-1412.1 as follows:

 8        (625 ILCS 5/1-117.7 new)
 9        Sec.   1-117.7.  Electric   personal  assistive  mobility
10    device.   A  self-balancing  2  non-tandem   wheeled   device
11    designed  to  transport  only  one  person  with  an electric
12    propulsion system  with  average  power  of  750  watts  (one
13    horsepower),  whose  maximum  speed on a paved level surface,
14    when powered solely by a propulsion system of that type while
15    ridden by an operator weighing 170 pounds, is  less  than  20
16    miles per hour.

17        (625 ILCS 5/11-1005.1 new)
18        Sec.  11-1005.1.   Electric  personal  assistive mobility
19    devices.    Every  person  operating  an  electric   personal
20    assistive  mobility device upon a sidewalk or roadway has all

 1    the rights and is subject to all the duties applicable  to  a
 2    pedestrian.

 3        (625 ILCS 5/11-1412.1) (from Ch. 95 1/2, par. 11-1412.1)
 4        Sec.  11-1412.1.  Driving upon sidewalk.  No person shall
 5    drive any vehicle upon a sidewalk  or  sidewalk  area  except
 6    upon a permanent or duly authorized temporary driveway.  This
 7    Section  does  not  apply to any vehicle moved exclusively by
 8    human power, to  any  electric  personal  assistive  mobility
 9    device, nor to any motorized wheelchair.
