 1                    AMENDMENT TO HOUSE BILL 4453

 2        AMENDMENT NO.___. Amend House Bill 4453, AS AMENDED, with
 3    reference to page and line numbers of Senate Amendment No. 1,
 4    on page 7, by inserting the following after line 31:

 5        "Section 1-35. Upon the payment of the sum  of  $3,000.00
 6    to  the  State of Illinois, and subject to the conditions set
 7    forth in Section 1-900 of this  Act,  the  Secretary  of  the
 8    Department  of  Transportation  is  authorized  to  convey by
 9    quitclaim deed all right, title, and interest in and  to  the
10    following  described  land  in  Morgan  County,  Illinois, to
11    George H. Perbix Jr. Trust dated March  22,  1991;  Jo  Ellen
12    Perbix  Kuzila  Trust  dated  November  30, 1998; Jill Perbix
13    Chabut Trust dated December 24, 1991.
14    Parcel No. 675X218
15    A part of the East Half of  the  West  Half  of  Section  26,
16        Township  15  North, Range 11 West of the Third Principal
17        Meridian, Morgan County, Illinois, described as follows:
18    Commencing at a found stone at the southwest  corner  of  the
19        Southeast  Quarter  of the Southwest Quarter of aforesaid
20        Section 26; thence North 00 degrees 50 minutes 20 seconds
21        East  (bearings  based  on  the  Illinois   State   Plane
22        Coordinate  System NAD83-West Zone), 1324.84 feet; thence
23        North 00 degrees 32  minutes  00  seconds  East,  1327.74

21        Section  1-40.  Upon the payment of the sum of $44,200.00
22    to the State of Illinois, and subject to the  conditions  set
23    forth  in Section 1-900 of this Act, the easement for highway
24    purposes acquired by the People of the State of  Illinois  is
25    released  over  and  through  the following described land in
26    Monroe County, Illinois:

32    Commencing  at  the  northwest corner of said Tax Lot 4, also
33        being the northwest corner of Lot 1  in  Admiral  Parkway

 1        Center,  a  subdivision  recorded  January  23,  1997  in
 2        Envelope  2-48A in the Monroe County, Illinois Recorder's
 3        Office; thence on an assumed bearing of North 89  degrees
 4        45  minutes 43 seconds East on the north line of said Tax
 5        Lot 4, also being the north line of said Lot 1 of Admiral
 6        Parkway  Center,  75.35  feet  to  the   most   northerly
 7        northeast corner of said Lot 1 of Admiral Parkway Center,
 8        said   most  northerly  northeast  corner  being  on  the
 9        southwesterly right of way line of FA Route  4  (Illinois
10        Route 3), said most northerly northeast corner also being
11        the Point of Beginning.
12    From  said  Point  of  Beginning;  thence North 89 degrees 45
13        minutes 43 seconds East on said north line of Tax Lot  4,
14        a  distance of 98.81 feet to a point 100.00 feet radially
15        distant southwesterly of the centerline of said FA  Route
16        4 (Illinois Route 3); thence southeasterly 225.92 feet on
17        a  curve  to  the left, having a radius of 3,680.99 feet,
18        said  curve  being  100.00  feet  southwesterly  of   and
19        concentric with the centerline of survey of said FA Route
20        4 (Illinois Route 3), the chord of said curve bears South
21        51  degrees  26  minutes  20  seconds  East, 225.88 feet;
22        thence South 12 degrees 47 minutes 21 seconds West, 71.05
23        feet to a point on said southwesterly right of  way  line
24        of  FA  Route 4 (Illinois Route 3), said point also being
25        on the northeasterly  line  of  said  Lot  1  in  Admiral
26        Parkway  Center; thence northwesterly 333.90 feet on said
27        southwesterly  right  of  way  line,   also   being   the
28        northeasterly  line  of  said Lot 1, being a curve to the
29        right, having a radius of 3,745.99  feet,  the  chord  of
30        said  curve  bears North 51 degrees 05 minutes 04 seconds
31        West, 333.78 feet to the Point of Beginning.
32    Parcel 800XB09 herein described contains 0.418  acre  (18,208
33        sq. ft.).

 2        curve  bears South 53 degrees 48 minutes 07 seconds East,
 3        15.27 feet to the most easterly northeast corner of  said
 4        Lot  1  in  Admiral  Parkway  Center  for  the  Point  of
 5        Terminus.
 6    It  is  understood and agreed that there is no existing right
 7        of access nor will access be permitted in the  future  by
 8        the State of Illinois, Department of Transportation, from
 9        or over the premises above described to and from FA Route
10        4, previously declared a freeway.".
