 1        AN ACT in relation to criminal law.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section 5. The Criminal Code of 1961 is amended by adding
 5    Section 7-13.5 as follows:

 6        (720 ILCS 5/7-13.5 new)
 7        Sec.  7-13.5.  Necessity  for common carriers. There is a
 8    rebuttable presumption that action or  possession  undertaken
 9    by a commercial airline pilot, navigator, engineer, or flight
10    attendant,  on  or  after September 11, 2001, is necessary to
11    avoid a public or private injury greater than the injury that
12    might reasonably result from his or her own conduct,  if  the
13    conduct  or possession is reasonably necessary to provide for
14    the safety of a commercial aircraft. In the case of a  person
15    who  flies  across  state  lines,  no  Illinois  or municipal
16    licenses for  carrying  concealed  weapons  are  required  to
17    establish this defense.

18        Section  99.  Effective  date. This Act takes effect upon
19    becoming law.
