92_HB3972ham001 LRB9215016WHcsam04 1 AMENDMENT TO HOUSE BILL 3972 2 AMENDMENT NO. . Amend House Bill 3972 by replacing 3 everything after the enacting clause with the following: 4 "Section 5. The Child Labor Law is amended by changing 5 Section 7 as follows: 6 (820 ILCS 205/7) (from Ch. 48, par. 31.7) 7 Sec. 7. No minor under 16 years of age shall be 8 employed, permitted or allowed to work: 9 1. In, about or in connection with any public messenger 10 or delivery service, bowling alley, pool room, billiard room, 11 skating rink, exhibition park or place of amusement, garage, 12 or as a bell-boy in any hotel or rooming house or about or in 13 connection with power-driven machinery; except this 14 subsection shall not apply to ice skating rinks owned and 15 operated by a school or unit of local government; 16 2. In the oiling, cleaning or wiping of machinery or 17 shafting; 18 3. In or about any mine or quarry; provided that office 19 and messenger and other non-hazardous employment shall not be 20 prohibited by this Act; 21 4. In stone cutting or polishing; 22 5. In or about any hazardous factory work; -2- LRB9215016WHcsam04 1 6. In or about any plant manufacturing explosives or 2 articles containing explosive components, or in the use or 3 transportation of same; provided that office and messenger 4 and other non-hazardous employment shall not be prohibited by 5 this Act; 6 7. In or about plants manufacturing iron or steel, ore 7 reduction works, smelters, foundries, forging shops, hot 8 rolling mills or any other place in which the heating, 9 melting, or heat treatment of metals is carried on; provided 10 that office and messenger and other non-hazardous employment 11 shall not be prohibited by this Act; 12 8. In the operation of machinery used in the cold 13 rolling of heavy metal stock, or in the operation of 14 power-driven punching, shearing, stamping, or metal plate 15 bending machines; 16 9. In or about sawmills or lath, shingle, or 17 cooperage-stock mills; provided that office and messenger and 18 other non-hazardous employment shall not be prohibited by 19 this Act; 20 10. In the operation of power-driven woodworking 21 machines, or off-bearing from circular saws; 22 11. In the operation of freight elevators or hoisting 23 machines and cranes; 24 12. In spray painting or in occupations involving 25 exposure to lead or its compounds or to dangerous or 26 poisonous dyes or chemicals; 27 13. In any place or establishment in which intoxicating 28 alcoholic liquors are served or sold for consumption on the 29 premises, or in which such liquors are manufactured or 30 bottled, except as follows: 31 (A) bus-boy and kitchen employment, not otherwise 32 prohibited, when in connection with the service of meals 33 at any private club, fraternal organization or veteran's 34 organization shall not be prohibited by this subsection; -3- LRB9215016WHcsam04 1 (B) this subsection 13 does not apply to employment 2 that is performed on property owned or operated by a park 3 district, as defined in subsection (a) of Section 1-3 of 4 the Park District Code, if the employment is not 5 otherwise prohibited by law; 6 14. In oil refineries, gasoline blending plants, or 7 pumping stations on oil transmission lines; 8 15. In the operation of laundry, dry cleaning, or dyeing 9 machinery; 10 16. In occupations involving exposure to radioactive 11 substances; 12 17. In or about any filling station or service station, 13 except that this subsection 17 does not prohibit employment 14 of a minor in areas within the interior of a convenience 15 store with gasoline pumps during daylight hours if: 16 (A) the minor is the son, daughter, grandson, or 17 granddaughter of: (i) a sole proprietor or partner who 18 has an ownership interest in the convenience store or 19 (ii) an officer or board member of an entity that owns 20 the convenience store; and 21 (B) the store is not located under any structure 22 (such as a canopy or awning) under which fueling 23 equipment is located and the motor fuel station portion 24 of the premises is approved by the Office of the State 25 Fire Marshal for unattended fueling with all equipment 26 necessary for that approval being fully operable; 27 18. In construction work, including demolition and 28 repair; 29 19. In roofing operations; 30 20. In excavating operations; 31 21. In logging operations; 32 22. In public and private utilities and related 33 services; 34 23. In operations in or in connection with slaughtering, -4- LRB9215016WHcsam04 1 meat packing, poultry processing, and fish and seafood 2 processing; 3 24. In operations which involve working on an elevated 4 surface, with or without use of equipment, including but not 5 limited to ladders and scaffolds; 6 25. In security positions or any occupations that 7 require the use or carrying of a firearm or other weapon; or 8 26. In occupations which involve the handling or storage 9 of blood, blood products, body fluids, or body tissues. 10 (Source: P.A. 90-410, eff. 1-1-98.)".
