 1                    AMENDMENT TO HOUSE BILL 3695

 2        AMENDMENT NO.     .  Amend House Bill 3695 as follows:

 3    by replacing everything after the enacting  clause  with  the
 4    following:

 5        "Section  1.  Short  title.  This Act may be cited as the
 6    Emergency Evacuation Plan for People With Disabilities Act.

 7        Section 5. Evacuation ordinances.
 8        (a) By January 1, 2004, a municipality in this State must
 9    adopt an ordinance requiring owners and managers of high-rise
10    buildings and hotels to adopt emergency evacuation plans. The
11    ordinance  must  include  definitions  of   "high-rise"   and
12    "hotel".
13        (b) At a minimum, a municipal ordinance must require:
14             (1)  That  a  building  or  hotel  owner  or manager
15        maintain a  list  with  the  name  and  location  of  any
16        resident,  guest,  or  employee who identifies himself or
17        herself as needing assistance because  of  disability  in
18        the case of an emergency building evacuation and the type
19        of assistance required.
20             (2)  That  a  building  or  hotel  owner  or manager
21        establish clear procedures for evacuation of people  with

 1        disabilities, including:
 2                  (A)   alternate  means  of  egress  for  people
 3             identified as   needing assistance;
 4                  (B) identification  and  posting  of  areas  to
 5             serve as assembly points for rescue assistance;
 6                  (C)  identification  of  volunteers or building
 7             employees to act as evacuation assistants in case of
 8             emergency;
 9                  (D) determination of  the  need  for  assistive
10             technology  to  facilitate  the evacuation of people
11             with disabilities in an emergency; and
12                  (E)  plans  that  are  readily   available   to
13             authorized   building  personnel,  firefighters,  or
14             emergency workers in case of an emergency.
15             (3) That appropriate building  and  hotel  personnel
16        receive   training   regarding   the   plan   and   their
17        responsibilities under the plan.
18             (4)  That an owner or manager conduct periodic tests
19        of evacuation procedures for persons with disabilities to
20        evaluate their effectiveness.
21        (c) The ordinance must include  enforcement  measures  to
22    insure  compliance.
23        (d)  In  the  process  of  developing  its  ordinance,  a
24    municipality must conduct public hearings to receive comments
25    from   advocates  for  persons  with  disabilities,  building
26    owners,  and  other  concerned  citizens  and  must   consult
27    authorities, experts, and existing standards and regulations,
28    including  but not limited to the Americans with Disabilities
29    Act Accessibility Guidelines.


30        Section 905.  The State Mandates Act is amended by adding
31    Section 8.27 as follows:

 1        (30 ILCS 805/8.27 new)
 2        Sec. 8.27.  Exempt mandate.  Notwithstanding  Sections  6
 3    and  8 of this Act, no reimbursement by the State is required
 4    for  the  implementation  of  any  mandate  created  by  this
 5    amendatory Act of the 92nd General Assembly.

 6        Section 999.  Effective date.  This Act takes effect upon
 7    becoming law.".
